Geonjia Interestiny Decision Cudtr the Sequestration ^4ci.—The case of the Contederate States against Wolfl et als., to sequestrate certain debts due by them to Elkers k. Brother, alkged to be alien enemies, was called up yesterday in the C. S. District Court, aud Judge Halyburton delivered Hargrove, ^ his opinion, indicating his purpose to dismiss the petition. Th« particulars of this novel case are as follows: Isaac Elkers, a native ol Prussia, emi- ; grated to this country many years ago, resided in : Mobile, Ala., for a long period, where he took out his last naturalization papers in 1S4U, Heestab- I lished a large clothing store in Mobile iu conjunc- j tion with hig brother, aud aitorwards, in 1853, ' removed to New York and there established a ■ branch house ol trade. He married in New \ ork, I bought a residence there, and voted there at the Presidential election ot 18*)0—voting against Lincoln, He frequently visited Mobile from 1851 to 1861, and continued a partner in the Mobile , house. In 1861, immediately after the proclama- ! tion of Lincoln, he shipped a portion of his goods i to Mobile and closed the New York house, but i remained in New York until September, 1861, ■ when he returned to Mobile, and took the oath ^ of allegiance t j the Confederate States in Novem ber. His family remained in New York, he al- ! leging that, in consequence of ill health, and for other causes, he could not remove his family South. It was argued in the progress of the case that the defendant was an alien enemy ou and after the iilst of May, 1861, and that his citizenship ■ in New York continued until September, when he removed from that State, aud that no change i of citizenship after the commencement of hostiii- , ties between the Confederate and the United States could protect the property ot an alien from I the sequestration act. The decision of the J udge in Elkers’ favor is based upon the fact that he had closed his busi ness in New York before the commencement of j hostilities, and that his’removal from the North ! was effected as soon as he could do so after clos- I ing his business. C.)
