The following gentlemen of the le
gal profession, irom abroad, are in the

time, which is $123,000,000 compared
to $600,000,000 which it was. prior to
the war. Just in that proportion am I
willing to pay on the ante beaum debt,
and no more. Now I wish to address
myself to the State bonds and other
liabilities incurred during and since the
war under acts passed prior to and dur
ing the rebellion. I do esteem this
class as valueless as Conlederate mpney.
As to State bonds issued under ordi
nances of the Convention of 1868, and
in pursuance of that iniquitous Legisla.
ture of 1868 '69, I will never cast a
vote to pay one dollar of them while I
occupy my seat on this floor as a repre
sentative of a part of the peeple of
North Carolina.
And now I will address myself to
this Turnpike road, which is one of the
legitimate, offsprings of that same un
holy and iniquitous Legislature' of 1868
'69 notoriety by which the virtues of
the once proud old North State was
trampled down by a horde of Northern
serls, who came within her borders as
political adventurers, and to prostitute
and pervert her virtues, revenues and
laws who desecrated her proud old
Capitol, and almost converted it into
a den of bawds, Shylocks, Railroad
Rings, &c. Why, sir, with these facts
belore the public, gentlemen ask me
how I get around my constitutional ob
ligation. I will say, sir, that I have
taken upon myselt that obligation
without any mental reservation to vio
late" its provisions, and I am substanti
ally sustained by one of our learned
Judges of the Supreme Court in his
opinion of the constitution, which he
declares is a medley of contradictions.
I believe, sir, the dividends declared
by the N. C. Railroad should enure
to the benefit of the bondholders of the
antebellum debt, which is sufficient to
pay the interest justly accruing thereon.
I will say here, once for all, that I do
not' recognize the validity of any part
of the debt created during or since the
war, and I charge you gentlemen here,
the friends of this measure, to beware
how you precipitate this infamous Turn
pike bill upon the people, for if you
ever protrude your political heads out
side ot your own counties, they will
certainly be stricken down.
I ask pardon for having trespassed
upon the patience of the House, and
hope it will be the good pleasure of the
House to vote this bill down.

form, offered a bill in relation thereto,
and submitted a verbal report to the
effect that the bill had been so prepared
that the written report would have con
tained a recommendation of a maiority
ot the committee that the alterations
proposed in the bill should be voted on
separately, but the Committee doubted
whether it was in their province, as a
committee, to make the recommenda
tion. That the maiority thought this
course necessary to insure the passage
of any alteration by this Assembly.

the indulgence ot the House to submit
a few brief rtmarks upon the bill now
under consideration. I must say tirat l

the developing of the rich mineral
and agricultural resources ot any por
tion of our grand old State. However,
much I may deplore this, duty con
strains me to oppose any measure like
this, involving, as I believe, more than
one hundred and fifty thousand dol
lars of hard earnings which this bill
proposes to wring from the pockets of
the tax payers without their consent,
to be devoted to an unholy ana un
righteous a cause as this proposition
seems to be.
What do the friends ol this measure
propose? Wny,sir, they propose to revive
an old charter of a Turnpike road,
known as the Asheville and Marion

The funds raised is to be disbursed
in the school Districts of the respective
counties of the State in proportion to

resolution.

Work Commenced. The selling of
the Fair Ground lots commenced yes
terday at 11 o'clock, but owing J.o

Railroad Accident. The Bridge
over Deep River, twelve miles of
Greensboro ou the North Carolina Rail
road, gave way yesterday while the
Eastern bound freight train was passing
over, and thirteen cars were precipita
ted into the river below. The engine
had passed over the bridge, and conse
quently no lives lost. . -
Death of a Prominent Citizen of
Franklin County. We are pained to
announce the death of Dr. A. S. Perry, bound over in the sum of $2,500 t,o
a highly esteemed citizen of Franklin
county, which occured at his residence
in that county on Sunday last. Dr.
Perry was a very influential citizen, and
his death will be greatly lamented by
a large number of friends and relatives.

The consideration of the Midland
North Carolina Railroad bill came up
as the special order for 1 o'clock.
Mr. Morehead, of RockiDgham, from
the Committee on Internal Improve
ments, submitted several amendments to
the bill;
The amendment to the sixth seTlion,
offered by Mr. Morehead, of Guilford, .
was first considered. The amendment
proposes to strike out what is termed the
banking powers, and the power to bor
row and loan money on securities.'
Failed.
.Pending discussion on other amend
ments, the Senate adjourned after
making the bill the special order for to- '
morrow at 11 o'clock.
When the bill is perfected we will
give the various amendments, in such a
form as our readers may know what it
is, and therefore consider it unnecessary
to detail the discussion on the amend

On motion of .Mr. Badger, the rules
were suspended, and the Senate bill
continuing the Joint Select Committee
to investigate the affairs of the Western
North Carolina Railroad Company, and
charging it with an increase of -diiiies,
k was taken up and, after some little de
bate between Messrs McGehee, Housi;;,
Robinson ,nd Badger, passed its several
readings.
On motion of Mr. Jones, of Caldwell,
the rules were suspended and the bill
to repeal the General Incorporation act
of 187l-'2, was taken up.
On motion of Mr. McGehee, the bill
was postponed until to-morrow at 11
a. m.
The bill to incorporate the Wilming
ton Trust Company and Savings Bank
came up as a special order.
Mr. Bennett's amendment limiting
the rate of interest which the Company
shall ask to 8 per cent per annum was
adopted, and the bill p tssed its third
roading.
On motion of Mr. Badger, the reso
lution in favor of James L. nenryt
Judge ot the 11th Judicial District.was
taken up. The majority report of the
Judiciary Committee unfavorable to the
passage of the resolution, and that of
the minority favorab!eto it, were read.
A very long debate ensued.
Mr. Waugh moved to lay the whole
matter on the table.
A vote was taken and the motion to
table was adopted by a vote of yeas
59, nays 32.
