The amount of interest due on the
so-called construction bonds of the
North Carolina Railroad wilf in all
probability amount by the 1st of
April, lH7o, to over $200,000.
The fiat lias gone forth, subject
only (o a reverse decision, of the
United States Supreme Court, that
unless this amount is raised by the
Legislature, either by taxation or
otherwise, and devoted to the pay
ment of said interest, tho North
Carolina Railroad will pass forever
out of the control of the State.
It will not do in this emergency
to remain inactive and with any de
gree of dependence on the appeal
taken to the Supreme Court. The
interests of our entire people, and
especially ' those of our Western
friends, are wound up in this mat
ter, and they look with breathless
anxiety for the Legislature to rescue
them. With the North Carolina
Railroad wrested from us, we may
bid an eternal farewell to that grand
scheme of consolidation which pro
mises the unearthing of so much of
the wealth of our beautiful moun
tain country.
We call upon the Legislature to
devise borne means at once to relieve
the people from this dilemma. Pro
vide the means first, and then await
the action of the higher court.
The following is the substance of
the opinion rendered by Judge Kerr
in the case of Cloud vs. Wilson, of
the 8th Judicial District. It will
doubtless prove of interest to many
of our readers:
Judge Kerr decides 1st. That the
words of the Constitution, Article
4, Section 31, " all vacancies occur
ring in the ollicts provided for by
thisarticle of the Constitution'' re
fer to a vacancy happening after an
oftice has been filled by an incum
bent, and that the failure of a person
to qualify who was at that first elec
tion Heeled as Judge, and who was
holding another office at that time
incompatible with theono to which
he was elected, did not constitute
such vacancy.
2nd. In regard to the allotment of
Judges into two classes : The Judges
of the Supreme Court who had
qualified (if a majority of the whole
number,) could proceed with and
superintend the division, as the re
quirement of Art. 4 Sec. 20 of the
Constitution is directory and not
imperative requiring me attend
ance of the Chief Justice and the
four Associate Justices ; but it is
not seen how one not then a Judge
could be allotted to any term.
3rd. In regard to the time for
which an appointment by the Gov
ernor to a vacancy shall hold, and
the construction to be put on the
words, 14 shall hold until the next
general election it Is considered
that the words 44 next general elec
tion " refers to an election of Judges
which, by Sec. 20 of Art. 4 of the
Constitution, was to occur every
four years. It is considered that the
words 44 until the next general elec
tion" cannot be extended into any
such construction or have the same
meaning as 44 for the uriexpired
term." The provisions are distinct,
for different offices and purposes.
By Art. 4, Sec. 32, it is provided
44 the officers elected at the first
election under the Constitution
shall hold their offices for the term
prescribed respectively next ensu
ing after the next election for mem
bers of the General Assembly, but
their terms shall begin upon
approval of this Constitution by
Congress of the United States."

of the men appointed could begin

successors are to commence the dis
charge of their duties, viz. : when
the regular election for Judges,
which was expected to occur every
four years, should take place, and
distinguished from the regular elec
tions for members of the Legisla
ture, to occur every two years.

and that this action be dismissed at
the costs of the plaintiff and claim
ant, to be taxed by the Clerk.
Appeal taken to Supreme Court.
The Message.
It is a matter of congratulation
that tho message of Governor Brog
den generally finds favor with the
press of the State regardless of par
ty. We produce the following from
Democratic journals; other com
ments will be given as our space
allows :
44 The message is a plain, candid
and unpartizan document, and
while Governor Broaden does not
make many specific recommenda
tions to aid tho members in their
labors, he at least has shown a son's
devotion to the true interests of his
State. It is well worthy the calm
consideration of our people and we
regret the necessity of foregoing its

44 The message of the Governor of
North Carolina was communicated
to the two Houses of the General
ssembly last Wednesday. It is a
candid exposition of affairs in the
State and a hopeful look ahead.
Conservative, dignified, courteous,
in spirit and manner, it is also clear
in its statements and full of practi
cal suggestions." Wilmington Star.
Mr. Blythe, on Monday, the 23d
inst., offered the following resolu
tion, which was. placed on the cal
endar :
"Whereas, Many citizens in this
State are sorely oppressed by the
practical workings of the internal
revenue laws of the United States,
which inure to the benefit of cer
tain manufacturers to the great in
jury of the producers of our coun
try; and whereas, numerous citi
zens are now being prosecuted in
the Federal Courts for the most tri
flling offences committed against
said laws from three to five years
past, and are being thrust in prisons
and their property sacrificed to pay
costs of said prosecution; and where
as, the enforcement of said laws is
not only engendering strife and con
fusion among the people, but is cm-

osoms a spirit of hatred and disre
gard for the Government itself;
therefore, be it
1. Resolved by the House of Repre
sentatives, the Senate concurring,
That our Senators in Congress be
instructed and our Representatives
requested to use their influence to
have said revenue laws repealed or
so modified as to relieve the masses
of the producers of the burdens
which are herein specified.
2. That the Secretary of State be
directed to furnish each of our Sen
ators and Representatives in Con
gress with a copy of these resolu
tions as soon as practicable.
The foregoing resolution passed
the House on Tuesday, the 21th inst.
The off year in politics is a favor
ite one with the Democrats. The
Cleveland Leader calls attention to
the fact that in 1862, right in the
midst of the rebellion, the copper
head Democracy carried Ohio, and
elected all the Congressmen but five.
The following year, however, the
Republicans carried the State by
over 100,000 majority. So in New
York, in 1862, Horatio Seymour
was elected Governor, but the fol
lowing year the Republicans carried
the State by an overwhelming ma
jority. If we judge the future by
the past, the reverses of the Repub
licans are but temporary, and this
we sincerely believe. North Caro
linian. Conference Reporter. We

sion of the Virginia Conference, met
last week at Elizabeth City. We
trust that the commendable enter
prise displayed by the young pub
lishers, Messrs. Rutter, Wrilder &
