A ridiculously long-winded trinl. That w'ms the verdict of every one who heard the trial of Spencer Tay lor L-.-t week before Magistrates S. Gilmer, W. 1L Dray and E. F. Wall. Old man Tsy lor had been charged, as reported last week, with coiicc:il ing hor-es tti!en from Mr. C. W. Callahan, of Newlerrv Mills, Wvthe totinty, Va. It was claimed by the prosecu tion that two bay horses were frtolcn from the stables of Mr. Callaghan on the night of Oct. 14th, and that that gentleman traced the eonrse of the thief through Wythe, Mont gomery, Floyd, Patrick and Carroll counties down the Fancy Gap road to a point wet of Mount Airy! That somewhere on or near the Blue Iiidgc the horses were taken in charge by one, Spencer Taylor, ami were brought down the Fancy Gap road into Surry county. Mr. Callnghan's friend from Vir ginia, went to the Little Mount tins and there captured Jacob Jackson and scut him otl to Wythe county jail. They then had Bpciicer Taylor arretted and placed in jail at this p ja e. . The trial la'gan on Tuesday Oc tober 27th and ended on hw-t Tues day niirht. Messrs. J. C. Buxton, of Wiiifcton, and Geo. W. Sparger, of this city represented the State and Messrs. S. P, Grave and W. F. Carter the defense. We wish.wc had space wherein to give the full evidence, but it. was -o long nd te dious we refrain. Crowds attended the trial day af ter day and it was one of tle longest for h magistrate's court on record. After hearing able and eloquei.t speeches from the attorneys on both sides the magistrates decided that there was a probible guilt of party arraigned aud that he lc committed to jail to await a requisition from the Governor. . j At this point in the case, when the decision of the court was made, defendant's counsel read an ntlir davit hignetl bv Mr. J. M. Fulton which stated tfiat he (Mr. Fulton) had reason to believe that certain magistrates had expressed opinions before the evidence was all in. This raised quite a breeze. After the presentation of other affidavits which claimed newlv discovered ev idence, the court adjourned for the purpose of dit-iding on a question, as to a new tiial, and to rejort.on Wednesday. At the appointed hour the court assembled, and after tho filing of a counter affidavit, announced that a iew trial would be given on the ground of newly discovered evi dence.
