(by request.) dlttective berry and the Reported 'Outrage is. Rich mond County. Having published a statement concerning alleged out rages in Uichmond county by Uni ted States soldiers, under the com mand o;' Detective Berry, afkl our information having lieen obtained from The Spirit of the .South and the Raleigh Ja, whic h we deemed good Republican authority, we give the Detective the benefit of his own denial in the matter : Raleigh, X. C, April 19, 1S73. JUr. Editor: In your newspaper, of the 17th instant, my attention has been called to an article enti tled " Whiskey Smuggling Oflicial Misconduct," which reflects upon my character as an officer, and as a gentleman. Your information, I observe, is derived from a newspa Ier published in Richmond county, called the Spirit of th& &uth, which in turn has been imposed on by some lying informant. The charges contained in the article are as fol lows : " We have been informed that the soldiers under the command of De tective Bf rry got drunk and lidliav ed themselves very badly at Laurel Hill, in this county, which place it seems they also visited, it being near Laurinburg. Our informant says that they amused themselves by firing otT their guns and pistols, ! and cursed and abused several citi- j zens. Their conduct ought to be looked into, and if they acted in j the manner that we are informed ! they did, they deserve to be court- , martialed and punished, and we ; frhould Ite glad to hear that it was done. The people have a right to ! ak that soldiers sent among them ! be made to conduct themselves pro- j Ierly, and we respectfully request Supervisor Perry to looK into this : matter.'' . " On the march of the expidition, ! a short distance out, a Republican! reports that Mr. Berry halted for ; the night, and on leaving in the morning attempted to evade pay- ment of the trifling sum of five i dollars for supplies furnished by a poor woman of limited means, tell- j ing her to " charge it to the United ! States government," but was finally j prevailed on to pay the sum by a Sergeant and some others of the ex- : pedition." The whole story is false from be- ; ginning to end, and has been hatch- j ed up no doubt by some individual j who was connected with the at-1 tempt made to evade the revenue j laws of the United States, and who ; has felt the result of my energy in ' enforcing thc law. None of the sol- ! diers who were with me" got drunk j and behaved badly" during the trip, j only one U. S. Soldier attached to I the expedition a sergeant, visited I the village of Laurel Hill, and he ! accompanied me to the village, and j returned with me. At no time du- j ring the trip were the soldiers al- ; lowed to " amuse themselves by tiring off' their guns and pistols" or to curse and abuse citizens.' The charge alluded to in the last para graph is a lie out of whole cloth, and but for the fact that it may im pose on thosVwhodo not know me," is hardly worth denying. 1 append in refutation ot the charges alluded, the affidavits of two individuals who accompanied the expedition. In conclusion, Mr. Editor, I desire to say, that my official acts are open tO.'the most rigid scrutiny, and I chaliege investigation, but 1 think I have a right to complain of the public press when they take the un proved statement of some violator of the law and herald charges against me without a particle of truth to base them on. The posi tion of a Revenue Agent is no sine cure, and it is not presumed that those whole rascality he unearths should speak well of him, and he expects slander and calumny to follow him when whole com munities aid and abet violators of the L'nited States laws. The Agent only asks that the friends of the government should not hastiiy denounce him before the facts have been ascertained. So far as I am concerned, however, the false charges alleged above, the condemnation of the press, nor any other efforts of the evaders of the Revenue Laws, shall deter me in Informing my duty to the govern ment. Respectfully, Matt Berry. I append the following affidavits: : State of North Carolina, Wake County. Personally appeared before me, W. Whitaker, a Justice of the Peace, in and for said State and county, Gustave Fritz, Sergeant, Battery G, Second Artillery, U. S. troops, stationed at Raleigh, and C. D. Upchurch, citizen of Raleigh, and maketh oath, that they were in the expedition alluded to above, and that the statement made by Capt. Berry is strictly in accord with the facts, and that the state ment made in the Spirit of the South is utterly false in all respects. Gustave Fritz, Sergeant, Battery G, Artillery, C. D. Upchurch.
