THE JURY BOX. Allegations of au Attempt to Coruijit Its Furity--A Deputy htriil Charged with Packing a Jury Albert Mag n in in Close (Quarters. A case w hich has excited a womb rful interest, and the interest in which has but begun, transpired yesterday during the sitting of the Superior Court. The ease of Mr.' Jos. A. Haywood agcinst Marcellus Rogers, colored a case of landlord against tenant or cropper had been called and Deputy Sheriff Manin was summoning the jury. Hon. Daniel G. Fowle and Mr. Geo. II. Snow ap peared for the plaintiff and "Messrs. Biikibee ifc Busbee for the defendant. A majority of the original panel w ere ne groes, and to several of the jurymen the plaintiff's counsel objected. Others were summoned, and the defendr nt's counsel after objecting peremptorily to four, objected then to jurymen for cause." until their challenges were ex hausted. The plaintiff "s counsel had in the meanwhile objected to several, imhi one ground and another, and the jury as finally made up had upon it but one of the original panel, and consisted of live whites and seven blacks, all of whom, of both colors, were Republicans. At this juncture Judge Fowle arose and made a motion for a continuance of the cause at the same time asking the court for a half hour's time in which to prepare affidavits, setting forth the grounds upon which he made the mo tion. He stated in asking for the time that it had come to his knowledge ih;t the jury hail been w ilfully, fraudulently and corruptly packed, with a view of depriving li ix client of justice. The time for whit h he asked was granted, and after an absence from the court room he returned" and presented three affidavits, signed respectively by Messi-i , Jos. A. Haywood, the plaintiff iu the action. Tims. P. Deveivux and J. I). Pullen. Mr. Haywood stated in his af fidavit that wjvile the .summoning of jurors was in progress lie saw Magnin wink significantly at the defendant, ami further, that when plaintiff's counsel had exhausted his challenges, he saw the sahl Magnin smile at the defendant, and shrug his shoulders. The affida vits of the two others set forth that they were witnesses of the same circum stances'. Mr. Haywood stated further in his affidavit that on the last election day he ami Magnin had an altercation, and this circumstance added to the bc lief that an effort was being made to deprive him of a fair trial. His Honor Judge Scheiiek sai l that, since the foregoing circumstances had been narrated, he called to mind the fact that he had observed Magnin. while in his search for jurors, start out ot' the front tloor, hiy; step at a touch uoon his arm from a negro hy-xtander. 1 hat the negro pointed him. to another w ho sat in the audience and said something to him, and that Magnin thereupon summoned as a juror the person who hat! been pointed out to him. Judge Fowle. in presenting t he affida vits, denounced Magnin in unmeasured terms. IK- said that truth and justice demanded that he should say' that he was not 'a. man who possessed the conti denee of the honest people of this com munity and county, and that ir w as per fectly manifest that his purpose was to deprive the plaintiff of justice in this matter. Judge Fowle characterized him in strong terms, and belabored him with fervid invective. Magnin engaged Col. Kd. t'raham Haywood to represent him. and Judge Sehenek granted him a right, which is unusual, that of .replying to a motion for a continuance. The motion was dismiss ed until this morning, when the dep uty sheriff will no doubt appear iu cent with counter-affidavit s. Judge Sehenek spoke temperate ly of the case under consideration, re marking upon it as a ease of great grav ity, and one into which partisan bias must under no circumstances be per mitted to enter. The conduct of the officer, if what was alleged is true, is reprehensible in the extreme, but the matter must undergo a thorough inves tigation before any action is taken up ,a it. Jones, of Wilmington, the American Sunday School Union has planted and aided in Xorth Carolina during the past twelve months about eighty schools. The one great aim of this timc-honoied society is directed in the channel of meeting the wants of hitherto neglected communities. An open Bible, placed in the hands of all. who can raid, with the injunction 'search the n riptures," and see wha' they testify of Christ and his doctrines, is the-platform on which this mission ary enterprise has maintained its posi tion through the past half century o our national existence. For every seventy-five cents con tributed to the American Sundax L uion, a child has leen placed under Bible instruction, while for want of christianedncatioii and proper training of the young it costs the several States of our Union over ten million nine 'hun dred and thirty thousand dollars for the annual support of pauperism and crime. Prevention is better than cure, edu cation is cheap er than punishment, and schools less costly than courts of justice and jails.
