Should a father have the
right to give by deed the cus
tody of his infant children to
some other person? This ques
tion has somewhat excited the
public in the recent case in Soutl
Carolina, wherein the wife 05
Ben Tillman Jr. is trying to se
cure the custody of her childrei
from her husband's father, tc
whom he had deeded them in ac
cordance with the law of Soutl
Carolina. This law has beer
severely criticised and condemn
ed by many persons and papers
in this State, who seemlto, be un
aware ofithe same llawiin'Nortl.

According to the law in thi
State (now section 1762 of th
Revisal) a father may not onlj
dispose of the custody of his in
fant child by deed in his lifetime,
but also dispose of their custody
by will. This may surprise the
critics of the South Carolina law.
But whether it is right is anoth
er question, and much may be
said on both sides. It certainly
seems wrong, and indeed cruel,
to allow the father tojtake the
children from the mother anc
commit their custody to some one
else. Naturally the mother lovet
her children more than the fath
er and does more for them and
deseryes their love more than the
father does. No earthly love
can exceed the mother's love foi
her children and it is the refine
ment of cruelty to take their
from her, unless she is proved
to be unworthy of their custody.
The truth of the matter is that
our laws are in many ways unjust
to women and they are unfairly
discriminated against in many
ways.
The Wilmington Chamber of
Commerce, composed of the
most prominent business men oi
that city, recently adopted very
complimentary resolutions in
memory of Gen. N. M. Curtis, oi
New. York, I who died last month
and who led the attacking force
in the capture of Fort Fisher,
where he was desperately wound
ed. This incident is a most pleas
ing and striking illustration oi
the reconciliation between the
North and the South and of the
obliteration of the passions anc
prejudices engendered by the
war between the States.
Fort Fisher was the gate
way to Wilmington and its
capture forced the evacuation oi
that city, and yet here are the
leading businessmen of Wilming
ton paying this tribute of re
spect and honoring the man whe
led the Union forces in the cap
ture of Fisher!
Gen. Curtis, together with a
large number of Union soldiers
who captured Fort Fisher, visit
ed Wilmington a few years ag(
and went to the place where Fort
Fisher once stood, and there hsd
a most pleasant reunion with
some of the Confederate soldiers
with whom they had fought in
January, 1865. And last year a
number of the Confederate vet
erans accepted an invitation from
Gen. Curtis and his associates to
visit ihem at Utica, New York,
where they were entertained
most hospitably. This illustrat
ed the kindly feeling of those
brave men who withstood one
another in bloody battle, and
quit fighting when the war wts
over.
Wireless telegraphy; saved
forty-six persons from a watery
grave on last Friday. The steam
ship Kentucky was in a sinking
condition about a hundred miles
off the coast of South Carolina,
when another ship rushed to the
rescue and safely took off all the
passengers and crew, so that no
body jas drowned, and soon
thereafter the steamer sank.
When it was found that the
steamship was in a sinking con
dition a message to that effect
was transmitted by wireless tele
graph and was caught by the
operator at Savannah and a
steamer was hurried to the res
cue. But for the wireless tele
graphic message the Kentucky
would have sunk and all on board
drowned, y
Does our high protective tariff
increase the cost of living?. The
advocates of the tariff law say it
Joes not, and those opposed to it
say that it does.
If the tariff does not increase
the cost of living it is very
strange that prices are higher in
this country than in Canada.' For
instance, at Detroit, in Michigan,
there is a greater difference in the
cost of living than just across
the river at Windsor, in Canada.
Taking a list of nineteen articles
jf ordinary food it costs 25 per
ent less to buy them in Windsor
than in Detroit. This fact speaks
louder than words and its prac
tical experience every day fully
sustains the contention of those
who say that our tariff does in
crease the cost of living.
In England Australian beef
retails for a little more than half
of New York prices, and beef
trom Argentina for less than
aalf. Granulated sugar, which
.3 sold at wholesale in New York
:'or 5.15 cents a pound, sells in
England for 3.66 cents. So that
ivery time an American buys al
nost any article of food or any

than he would have to pay in

laws.
Lumberton, N. C, Feb. 7. A
most unfortunate accident occurred
here Saturday when the little two
year-old child of Mr. and Mrs.
Roger Collins, residents of Wis
harts township, was burned to
death. It seems that the little

near a burning brush heap and
somehow escaped notice by its par-;
ents until it was seen running '
clothes all aflame. The child was
an severely burned that nothing
could be done for it and death re
sulted immediately.

Three unidentified men held up
and robbed the passengers on an
eaatbound Missouri Pacific pas
senger train, near Pittsburg, Kan
sas, on last Saturday.
The death of Hon. James E.
Shepherdwas a grievous shock
;o his many friends and a great
oss to this state. He died sud
lenly on last Sunday night at a
lospital at Baltimore, where he
lad gone the day before for treat
nent on account of a bronchial
trouble.
The deceased was one of our
State's most distinguished jurists
laving attained the highest judi
cial position in the State, that of
Chief Justice of the Supreme
Court, and that high office he
illed with great honor to himself
and credit to the State. His
career in life is a notable illus
tration of the possibilities of the
American boy, and his example
-nay well be emulated by the
youths of our country. Both of
lis parents died when he was a
small boy and the reverses of the
vvar forced him for a livelihood
to become a telegraph operator,
md while so employed he im
proved his leisure moments in
studying law, and without the
advantages enjoyed by so many
other youths he rose to the high
est judicial office in this State.
The Senate of the United
States, with only one negative
vote, passed a resolution on last
Monday, allowing the Confeder
ate veterans to use some of the
government tents at their re
anion to be held at Mobile next
April. All the Democratic Sen
ators and all the Republican Sen
ators, except Heyburn of Idaho,
v'oteH for this resolution.
Senator Heyburn made a bitter
speech against the resolution and
waved the "bloody shirt" most
frantically, but all in vain, and
after he had subsided and sat
iown, the only thing said by any
other Senator was by Senator
Bankhead, who quietly remark
ed, 'T am sure the Senator from
Idaho feels much better and I
ask for a vote." Even Heyburn's
colleague from Idaho voted for
the resolution.
The people of Jonesboro town
ship, Lee county, at an election
last Saturday, voted for a bond
issue of $15,000 for good roadg.

Thomasville,' Feb. 6. It will
be a source of deep sorrow
throughout North - Carolina to
know that there are to day fifteen
cases of small-pox at the Thomas
ville Baptist Orphanage. The
fact was discovered a few days
ago by Dr. Julian, the orphanage
physician, and the disease has
spread to some extent. Miss
Olive, one of the teachers, also
has it, along with fourteen of the
orphans.
The Statesville Landmark says
that the Iredell county home is a
disgrace to tbat county. There
are no doubt many other county
homes that'are just as disgraceful.
