And be it further enacted, lnat the true intent and meaning of the oath prescribed in said supplementary act is (among other things) that no person who has been a manlier of the Legislature of anv State or who has held anv ex eeutive or judicial office in any State, whether he has taken an oath to support the Constitution ot the United States or not, and whether he was holdinsr such office at the commencement of the rebellion or had held it before, and who has after ward engaged in iusurrcction or rebellion against the United States, or given aid or comfort to the enemies thereof, is entitled to be registered or to vote ; and the words "executive or judicial office in any State " in said oath mentioned shall be con strued to include all civil joffices created by law for the administration of the eeneral law of the State, or for the administration of justice, Sec. 7. And be it further enacted, lhat the time for completing the original registration pro vided for in said act niav, in the discretion of the commander of anv district, be extended to the 1 st day of October, 18G7 : and the boards of regis tration shall have power, and it shall be their duty, commencinc fourteen days pnor to anv election under said act, and upon reasonable pub lic notice of the time and place thereof , to revise for a period of three days the registration lists : and upon being satisfied that any person not enti tled thereto has been registered, to strike the name of such person from the list. And-such board shall also, during the same period, add to such registry the names of all persons who at that time possess the qualifications required by said act who have not been already registered, and! no person shall at any time be entitled to be registered or to vote by reason of any executive pardon or amnesty for any act or thing which, without such pardon or amnesty, Would disqualify him from registration or voting. Sec. 8. And be it further enacted, That section 4 of the said last named act shall be construed to authorize the commanding general named therein, whenever he shall deem it needf uL to remove anv member of a lioard of registration, and to appoint another jierson m his stead, and to nil any vacancy m such board Sec. 9. That all members of said Boards of Registration and all persons hereafter elected or appointed to office in said military districts, under any so-called State or municipal authority or bv detail or appointment ef the District Commanders, shall be required to take and subscribe to the oath of office prescribed by law for officers .of the United States Sec. 10. That no District Commander or mem ber of the Board of registration or any of the officers or appointees acting "under them shall lie bound in his action by any opinion of any civil officer of the United States Sec. 11. Moved by these consider ations, the following regulations are announced, und they will continue in force with such modifi cation as the ocenrion may require nntil the civil government of the rcsjiectivc States shall be es tablished in accordance with the requirements of the Government of the United States. The com manding General earnestly desires and confidently liclieves that the ofiscrvanoe of these regulations and the co-operation of all persons concerned in employing fairly and justly the advantages still rcmaing to them, will r.irtinite the distress now existing, and that the avenues of industry, enter prise, ami organization thus opened will contriV ntc to the permanent welfare and future happi ness of the jcople. First ; Inprisonmentfor debt is prohibited, un less the defendant in execution shall tie convicted of a fraudulent concealment or disposition of his pro;crty with intent to hinder, delay, and prevent the creditor in the recovery of his debt or demand", and the proceedings now established North and South Carolina respective! v, for the trial and dc tcrmitiiiig of such questions, may be adopted. Second. Judgment or decrees for the payment of moncv on causes of action arising between the l'.Hh of ' December, 18G0, and the 15th of May, 18fl.", shall not be enfoned by execution against the property or the nsrson of the defendant. Pro ceedings in such causes of action now pending shall !c stayed, and no suit or process shall be hereafter instituted or commenced for any such causes of action. Third. Sheriffs, coroners and constables are hereby directed to suspend for twelve calendar mouths the sale of ali projierty upon exeevtion of process on liabilities contracted prior to the 19th of Deceinlier, 1800, unless upon the written con sent of the defendants, except in cases where the plaintiff, or in his absence his agent or attorney, shall upon oath, with corroborative testimony, al lege or prove that the defendant is moving or in tends fraudulently to remove his property qeyond the territorial jurisdiction of the Court. Thesale of real or personal projerty by foreclosure of mortgage is likewise suspended for twelve calan dar months, except in cases where the payment of interest money accruing since the l;"th day of May, 1805, shall not have leen made before tho day of sale. ; Fourth. Judgments or decrees entered or en rolled on causes of action arising sulseqnent to the 15th of May, 18GT, may l indorsed by execu tion iigainst the jirojierty of the defendant, and in the application of the money arising under such executions, regard shall lie had to""the priority of liens, unless in cases where the good faith of any lieu shali lie drawn in question. In such cases the usual mode of proceeding adopted in North and South Carolina respectively to determine that question sh.-il be adopted. 1 ' ifth. All proceedings for the recovery, of mon ey under contracts, whether under seal or by pa role, tlie consideration for which w as the purchase of negroes, arc suspeuded. Judgments or decrees entered oivenroMcd lor such causes ot action shall not be enforced. Sixth. All ndvnnces of moneys, subsistence, iin- piomcnt, and fertilisers, loaned, used, cmiilovcd, or required for the purpose of aiding the agricul tural pursuits of the people, shall lie protected, nd the existing laws which have provided the most efficient remedies in such cases for the lender will lie supported and enforced ; wages for lalior performed in the production of the crops shall lie a lien on the crop, and payment of tlie amount due for such wages shall lie enforced by the like remedies provided to secure advances of money and other means for the cultivation of the soil. Seventh. In all sales of property and execution by order of any court there shall be reserved out of the propcrtv of anv defendant who has a fami ly dependent upon nis or her latxjr a dwelling- house and appurtenances and twenty acres of land for the use and ocrupation of the f amiiy of the defendant, and necessary articles of furniture, ap parel, subsistence, implements of trade, husbandry or other employment of the value of $500. The homestead exemption shall inure snly to the ben fit of families that is to say, paTent or parents and child or children in other cases the exemp tion shall extend only to clothing, implements of trade or other employment usually followed by the defendant, of the value of $100. The exemp tion hereby made shall not be waived or defeated by the act of the defendant The exempted prop erty of the defendant shall be ascertained by the Sheriff or other officer enforcing the execution, who shall specifically describe the same, and make a report thereof m each case to the Court. Eighth. The currency of the Uuited States de-; dared by the Congress of the United States to bo a legal tender in the payment of all debts, dues, and demands, shall lie recognized in North and South Carolina, and all casos in which the same shall lc tendered in payment and refused by any public officer will lie at once reixrted to these headquarters or to the commanding officer of the post within which such othcer resides. Ntnth. Property of an absent debtor or one charged as such without fraud, whether consist ing of monev advanced for the purposes of agri culture or appliances for the cultivation of the soil, shall not be takeu under tlie process known' as foreign attachment ; but tnc lien createa uy anv cxistins law shall not be disturbed, nor shall the possession or the use of the same be in any wise interfered with except in the execution of judgment or final decree in cases where they are authorized to be enforced. TenHu In suits brought to recover debts known as actions ex contractu bail, as heretofore author ized, shall not be demanded by the saitor nor ta ken by the sheriff or other officer serving the pro cess ; "in suits for trespass, libel, wrongful conver nronertv. and other cases, known as ac tions ex delicto bail, as heretofore authorized, may lie demanded and taken. The prohibition of bail in cases ex contractu shall not extend to persons about to leave the State, but the tact ot intention must be clearly established by proof. Eleventh. In criminsl proceedings the usual recognizances shall be required and taken by the proper dvil officers heretofore authorized by law to take the same, provided that upon complaint being made to any magistrate or other person au thorized by law to issue a warrant for breach of the peace or any criminal offense it shall be the Antv nf such magistrate or officer to issue his war rant on the recognizance of the complainant to prosecutes without requiring him to give security on sucn recognizance. .
