THE TEST OATH IN VIRGINIA. The United States District Court for the Eastern District of Virginia assembled on Tuesday at Alex-" andria. Francis Smith, lawyer of Alexandria, who participated in the rebellion, made a speech, in which be contended that, having been pardoned by the President, he was entitled to be admitted to practice at that court without being required to take the test oath as -provided for by act of Congress; that the pardon absolved him from all accountabili ty for taking part in the rebellion, end be should be considered in the stfme light ss a person who had been loyal during the war, and should be permitted to practice upon taking the customary oath requir ed from Attorneyg.
