His II mor replied in-tubstance, that it bad been said by high authority, that few things are involved iu greater doubt in the crimiunl law, than the point at which a combination of several persons in a common object beenuic illegal. If this he so in Kugland in regard to associations nf a political charactnr, still more must it be so in this country. Hut to make the conspi racy or agreement criminal, the act proposed must be utUairtult or the combination and agree ment must lie to effect a li gul purpose bv illegal moans. ' The administration of ua oath to the mcraiierf uf any Society uot to divulge iu secrets, or to do or not to do any particular act, is no binding obligation, and iu a moral point of view decidedly wrong.
