ASSAULT CASE BOUND
OVER TO SPRING TERM
On a plea of “not guilty” Hu
bert Turner and C. G. Carson were
bound over to January term of Polk
County Superior Court for “as
sault and battery with intent to
kill Lum Waters, 84, with a dead
ly weapon, to-wit: with rocks or
or a ,boulder.” >,

rests.
Turner is charged in one war
rant with the above charge and
Carson is charged “as an accessory
before and after the fact.”
Bonds were set by Magistrate
Monte Dedman for ’ Turner at
$1,000, and Carson at $500. They
were taken back'to jail in lieu
of bail.
The assault took place Satur
day.
Besides the two already in cus
tody, a third warrant was sworn
out for the arraignment of an
other man charged with “being
an accessory to the assault.”
In summing the case up, Magis
trate Dedman said, “I believe it is
one of the most dastardly crimes
that has been committed in Tryon
township in over 25 years.”
Mr. Waters, the victim is report
ed to be in “fair condition”, de
spite his age.
Also during the session Monday
night 29 traffic cases came before
the court, besides three other de
fendants who were put under bond
for January Term, 1952, for driv
ing drunk and reckless driving,
sworn out by W- R. Boyles and
E. M. Cowan, resident State High
way Patrolmen.
