Ned Anderson Opposes His Fiemoval From Board Local observers had predicted that Ned Anderson, chairman of the Polk County Board of Elec tions, would fight the order of the State Board of Elections removing him from office. An Associated Press story from Raleigh in today’s Asheville Citi zen has a full column concerning the case. Through his attorney, R. L. Whitmire, Chairman Anderson, was granted a restraining order by Judge F. Don Phillips, who will review the State Board’s rec ord of the case at Burnsville on October 23, at 11 a m. In Anderson’s petition to the court he asserted that he was “appointed for a two-year term, that the state board arbitrarily and summarily undertook to remove him from the office contrary to due process of law; that he had no notice of any charges against him; no opportunity to prepare a de fense; no opportunity to be heard in opposition to any charges and that as the holder of the office he is entitled to the emoluments there of and of which he nas been de nrived without due process of law.” Judge Phillips will decide the validity of Anderson’s removal.
