The Polk County Department
of Social Services Board has
received a letter from the State of
North Carolina Attorney
General's Office that the
employment of William A.
McFarland as attorney for the
Social Services board was legal
and that his services should be
viewed as valid and binding.
Commissioner Opal Sauve had
claimed that Mr. McFarland had
served illegally.
Henry H. Burgwyn, Assistant
Attorney General stated in his
letter that as the law is now
interpreted, if the board of
county commissioners assert
their statutory and contractural
duties (rather than designate
them) the County Commissioners
have the power to appoint the
attorney and the Board of Social
Sendees has the right to give
their approval.
