Zoning Charges
Polk County's zoning ordinance
is valid. Planning and Zoning
Administrator David Draughn
said Thursday.
Draughn and other county
officials were working
Wednesday and Thursday to
evaluate the charges leveled by
Claudy Pack during a public
hearing Tuesday night
Pack was putting on record his
objections to zoning the Skyuka
Road area RE-1, residential with
one acre minimum lots. Pack
owns 52 acres of the 840 being
considered for zoning, and is the
only vocal opponent among the
landowners in that area, 90% of
whom have signed a petition
favoring the zoning
Pack's attorney, Walter Currie
of Asheville, told the board Pack
may sue if the zoning is
approved. He said for one thing
the county’s zoning ordinance
may be invalid, since it calls for
any zoning area to be of at least
640 continguous acres.
The zoned area around the
town of Columbus is less than 640
acres, Currie said, and that fact
may invalidate the ordinance.
But Draughn said Thursday
that when the area around
Columbus was zoned, it was more
than 640 contiguous acres. The
zoned area was broken up when
the Town of Columbus annexed a
portion in the 1970s, Draughn
said

zoning actions can only be
contested within the first nine
