The weather Wednesday: high
49, low 16, hum. 58 percent.
We were all so looking forward
to snow, but by 2 p.m. Thursday,
there was none. Il was unusual to
us to see school called off for miles
around just on the threat of snow.
Perhaps the school kids will take
up a collection and pay off the
weatherman for more such predic
tions!
The persons who've purchased
"lifecare" residences in Tryon
Estates were to meet with corporate
officers of ACTS, Inc. this morning
at the Tryon Fine Arts Center.
In light of recent announcements
that Tryon Estates lost its financing
with First Union Bank, this was
expected to be a very important
meeting.
Tryon Estates executive director
Sam Collier said, "We have some
positive things to relate to our resi
dents."
He said some progress has been
made in locating new financing and
that progress will continue to be
made.
There is one rumor about ACTS
floating around that we asked Col
lier about, and that is that ACTS
was taken over last year by another
firm.
Collier said ACTS, Inc., a non-
profit corporation, was not taken

Beechwood Residents
Cannot Appeal Ruling
The Town of Columbus' rezoning
of five acres along Hwy. 108,
which was opposed vigorously by
several residents of Beechwood,
was ruled on Jan. 15 by the N.C.
Court of Appeals to be legal.
The case was heard Dec. 4, 1990,
18 months after the rezoning
occurred.
Virginia Dale said she and the
two other plaintiffs in the case,
Irwin Winter and Jerry Shannon,
have not had a chance to review the
appeals court brief to decide
whether or not they will continue
the appeals process, taking the case
to the N.C. Supreme Court.
But Columbus Town Attorney
Chris Callahan said the plaintiffs
have no right of appeal since the
appeals court judges were unani
mous in their decision. If the judges
had split the decision, the plaintiffs
would have a right to ask the
Supreme Court to hear the case, he
said.
"The most they can do now is
petition for a 'discretionary
review'," Callahan said. The
Supreme Court judges have the
option to hear or not hear a review,
Callahan said.
Callahan said he has never filed
for a review, and he did not know
how long the plaintiffs have before
they must decide.
Bill Wakefield, the owner of the
property and owner of Wakefield
Buick in Spartanburg, said he
believes the case has dragged on
too long already.

TLC Chevrolet/GEO on South
Trade Street just across the state

At Tryon Rotary
Monday, Jan. 28 at noon, the
Tryon Rotary Club will hear
Henry Janiec, Director of
Brevard Music Center.
This is Mr. Janiec’s 26th year
at the Brevard Music Center.
Since 1965 he has served as
principal conductor of the Music
Center Orchestra and the Opera
Workshop, as well as making
guest appearances with other
performing groups of the Center.
In addition to his artistic
duties, in which he is charged
with the direction of the
educational and performance
programs of the Center, he also
serves as its principal
administrative officer.
A native of NJ, Janiec joined
the faculty of the School of Music
at Converse College in 1952 after
graduating from Oberlin
Conservatory. He was appointed
Dean of the School of Music in
1967. Janiec has been principal
conductor or music director of
