\Varranties A warranty is the guarantee of a manufacturer or II that the product being sold is fit and sound jise by the buyer. They must be written in ordinary age, not in confusing legal terms. Every term d condition of the warranty must be spelled out fating. It is important to beware of spoken explanations or promises regarding a warranty on a product. Vfords of the salesperson will not be proveable or enforceable when repairs on the product are eeded. Rely only on what is written in the warranty. If the warranty says “you buy this product as Is” the seller is not responsible and the buyer must pay for repairs. Xhere are two types of warranties - Express and Implied. Express warranties are written promises IIIHIIIIIIII HIIIIIIIMIIII Illllllllllllllllllll you and the law in the contract. Implied warranties are rights created by state law to insure that products are fit for the particular purpose for which they are sold. An express warranty can be full or limited. A full warranty means that a defective product will be repaired or replaced free if necessary. The repairs will be made within a reasonable length of time after a complaint is made by the buyer. The warranty is good for anyone who owns the product during the warranty period. If the product can’t be fixed after a reasonable number of tries, a new pnxiuct will be made available or the money originally paid for the product will be returned to the buyer. A full warranty gives the most protection to the buyer. A full warranty, however, does not have to cover the entire product. It may cover only part of the product, like the picture on a television, or it may exclude certain parts like the tires on a car. certain to check the warranty to see what jwfts of the purchased product are covered. A limited warranty means “be careful - something is missing.” Limited avarranties, for example, may cover only the price of parts but not the cost of labor, or may offer a smaller refund than the full original price, or may charge the buyer fees for handling and postage. Normally all warranty rights include the right to “consequential damages.” This means the manufacturer must not only fix the product that needs repairs, but must also pay for any damage the product caused. For example, if a buyer’s beezer breaks down and the food in it spoils, the company must pay the buyer for the food that’s ost.
