the Defendant iu the above case is not a resideut
of this State : It is ordered, therefore, by the Court,
that publication lie made in the Raleigh Times fur
six weeks, notifying the Defendant of this proceed
ing ; aud further, that he be and appear before the
Justices of the Comity Court of Pleas and Quarter
Sessions, at the next Court to be held for the County
of Hertford, at the Court House in Winion, on the
Fourth Monday in November next, then and there
to replevy the property attached and plead ; other
wise final judgment will be entered up against him,
and the piopi-rty condemned subject to the recovery
of the Plaintiffs, agreeably to act of Asicinbly iu such

kin to the said David Outlaw, deceased : It is ordered
by the Court, that pub icatios be made in th Raleigh
Times, a newspaper published in she City of Raleigh,
for six weeks, for the said next of kin to appear at the
next Court of Pleas and Quarter Sessions, to be held
for the said County of Franklin, at the Court House
in Louisburg, on the second Monday iu December,
1S49, and contest the Probate ol the said Will, If they
