BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE TOWN OF DUNN: V SECTION I. That for the pur pose of this Ordinance the follow ing definitions shall apply' unless the content clearly indicates an other meaning or unless elsewhere expressly stated. K. The term “garbage” shall mean every accumulation of ani mal or. vegetable food-stuff that attends the preparation, consump tion. dealing-in; or storage* of meats, fish, fowl, fruit or vegeta bles Including the cans, containers or wrappers. JB. The term “rubbish" shall mean printed matter, paper, paper board, pasteboard . boxes, rags, straw, and all other combustible material not included under the term “garbage”. C. The term “refuse” shall mean and Include any waste product which is composed of such mate rials as garbage, sweepings, trash, litter, animal matter from kitchens, dining rooms, markets, food estab lishments or other places dealing in or handling meat, fowl, fruits, grain, shrub trimmings, grass clip pings, brick, plaster, or other waste matter' resulting from (he demoli tion, alteration or construction of buildings, accumulated waste ma- 1 terials, cans, containers, tires, junk, or other substance which may be a nuisance. D. The term “waste matter" shall mean waste material composed of soil, gravel, stone, bricks, plaster, crockery, glass, ashes, cinders, metals and all other non-cumbust ible materials which have been dis carded or is to be discarded. E. The term “collector” shall mean the Town of Dunn, North Carolina, or employees or agents thereof who are engaged in the collection or transportation of rub rlsh, garbage, or waste matter in any part of the Town of Dunn. SECTION 11. REFUSE REQUIR ED TO BE PROMPTLY RE MOVED. No refuse that has become decayed or that shall otherwise be a menace to health or cleanliness shall be allowed to remain In any business establishment, dwelling house, or on any premises longer than jhali be reasonably necessary tq remote and deposit Che same in containers of the type as pro vided by this Ordinance. SECTION 111. DEPOSIT OF REFUSE IN PUBLIC PLACES OR ON PRIVATE PROPERTY. RODENT CON TROL. No person shall store, de posit, or keep refuse in any place or in any manner where rodents can have access to or feed thereon, or can use such refuse as harbor age, nest, or breeding place. SECTION V. INCINERATION. No person shall bum garbage, or rub can have access to or feed thereon, blsh at any place, or in any manner violating a provision of the sanitary code or likely to create a health or property hazard or a nuisance. A. Under no circumstance shall any material causing excessive smoke, liberating a toxic substance on combustion, or producing a noxious odor likely to affect the occupant or any premises, be burn ed except under conditions approv ed by the Fire Chief or a member of the Fire Department designated by ordinance of the Board of Com missioners. B. The occasional burning of small quantities of dry rubbish, paper, paste board boxes brush, dry leaves, and similar materials on private premises under con trolled conditions shall be accept able provided the above conditions are compiled with in all other respects. 1. CONSTRUCTION OR DEMOLITION OF BUILD INGS Every person, building con tractor, or sub-contractor engaged in the construction, repair or demolition of any nuliding or structure or part thereof, shall i remove and dispose of, In an au thorized manner from any street, alley, gutter, park, sidewalk, curb ing, curb space, any public way or any premises not owned by him all waste matter or rubbish depos ited thereon in connection with that portion of the repair, con struction or demolition work under hts special or general supervision. A. Such refuse, waste matter and rubbish shall be cleaned up, re moved, and disposed bf in a sani tary manrfer within seven day.? of the final cessation of work on such building or structure unless specif ically authorized by the Building In spector or Superintendent of Sani tation. ' B. Such waste matter and rub bish shall not be placed on the sidewalk for town trucks to move, but shall be moved by the con tractor or sub-contractor who caus ed the game to be formed. SECTION VII. LAND. No per son, owner, agent or occupant of a lot or premises whereon a building of any kind may exist or of a va cant lot shall allow any collection of garbage, rubbish, waste matter, or filth of any description to re main on such lots or prqjnises af ter being notified by the Superin tendent of Sanitation to remove the same. SECTION VIII. STANDARDS FOR THE ACCUMULATION OF REFUSE. The following standards and requirements are established as a minimum for the sanitary ac cumulation of storage of refuse pending its removal by the collect ors of the Town of Dunn. A. OCCUPANTS IN CHARGE OF BUSINESS BUILDINGS. 1. Occupants of business build ings shall store and keep stored all refuse or garbage accumulating in said building or on its premises in metal receptacles which shall com pletely confine such refuse or gar bage pending its removal. EXCEPTIONS: Business lirms having large volumes of cardboard boxes will cut apart, straighten out, crush or stack such boxes into compact packages or bundles and secure with binding material such as' string or cord so that 'such bundles or packages will remain compactly bound to allow for easy handling in collecting. 2. The occupant of any business establishment will provide at his own expense the number of ap proved tontainers required to con- I tain the accumulated refuse or other waste material resulting from his business operations. 3. The lid must be chained or tied with a rope with a detchable fastener (such as a bridle snap) to the container so that the ihh will not be lost or blown away or otherwise destroyed. Where lids have been previously lost, damag ed, or destroyed, they are to be replaced with appropriate metal or wooden lids. 4. Portable metal receptacles of standard galvanized, water tight construction with tight-fitting cov ers and handles or balls are re quired. The size of the receptacle shall not be less than 10 gallons nor more than 33 gallons capacity. Receptacles not complying with the foregoing regulations, such as wooden or paper barrels, tubs, paint buckets, tanks, lard cans, or of such nature, are hereby prohibited Defective receptacles must' be re placed immediately. 6.‘ It shall be unlawful to place on the streets, sidewalks, alleys, or other public thoroughfares in the Town of Dunn in the first district any cardboard boxes, paper, •wooden crates, debris or other pack ing materials, except that such ma terials be placed in approved con tainers. Such containers must be of such quantity and size to hold at least one day’s accumulation of rubbish or refuse. The occupant shall be responsible for furnishing the necessary containers and com plying with the ordinance as to their proper use. 6. Trash or debris resulting from sweeping or cleaning the floors of such business establishments must be picked up by appropriate meth- Power Co. (Ceatinned from page one) closed by E. N. Thus it is possible for one town to take $2,000 in prize money. In addition, Mr. Vope said, there will be 15' prizes of SIOO each for honorable men tion. “Nobody loses,” Mr. Pope obser ved. “Even if your town is not one of the 23 prize winners, the com petition will bring its reward in terms of civic pride and improve ments for the community.” There is no gimmick as far as his com pany is concerned, the advertising manager said. “Our company ex ods and piaced in approved con tainers. To sweep such trash onto the sidewalk, gutter, or street is hereby prohibited. B. HOUSEHOLDERS: 1. The occupant of any house, apartment, or part of a house used as a separate place of abode shall cause all garbage collected therein or arising from the use thereof to be placed in water-tight, rodent proof and dog-proof receptacles of the type specified by this ordinance. 2. Occupants must furnish as many approved receptacles as need ed to hold at least one (1) week’s accumulation of garbage. 3. Receptacles must have well fitting lids so as to make them rain-proof. The lids are to be chained, or tied with ropes to meta or wooden stakes higher than the container so that the lid will lot blow away from the area and be lost or destroyed. Where lids have been previously lost, damaged or destroyed they are to be replaced with appropriate metal or wooden lids. 4. Occupants shall take every opportunity to put wet garbage from the kitchen in paper sacks or wrap in newspapers and tie the same with string so as to facilitate easier handling and emptying of the garbage container?. . 5. Such materials as tree branches, shrubbery, trimmings, box crates, or otper refuse of wood must be sawed Up, broken up, or crushed into such small pieces as will go into the available contain ers. Receptacles must be placed in approved types of metal, wooden, concrete or other type of racks so that they may not be turned over by dogs. Otherwise, receptacles must be placed in approved under ground containers as sold by cer tain manufacturers ao that they become dog-proof to the extent that dogs cannot molest the contents therein. . 7. Turned over receptacles are the responsibility of the owner or occupant to replace refuse back In the container and not the respon - sibillty of the collectors of the Town of Dunn. SECTION IX. Any person, firm, or corporation violating any of the provisions of this Ordinance shall be guilty of a misdemeanor, and upon conviction thereof be fined $25.00 or imprisoned for ten dayfe: and each day upon which violations accrue shall be a separate and dis tinct offense. SECTION X. All Ordinances or parts of the Ordinance in conflict with the provisions of this ordin ance are hereby repealed. SECTION XI.
