C Tart (Continued from Fage Onel The argument out of which the Tight arose. Goodman said stem med from an argument he had early in the day wi h Mrs. Pauline Tart, wife of Thomas Tart. Good, man said he went to Mrs. Tart, i well-known South Erwin business | woman, to demand payment of the > 15-year old daughter who had work ed for Mrs. Tart in the tobacco har vest. He quoted her as calling him a liar and he retaliated by striking her with his fist. MRS. TART TESTIFIES Mrs. Tart, who also took the stand, told about the same argu ment. She contended that the Goodman girl has asked her to withhold the wages and not to pay anyone because she wanted to save her money for school clothes. She said Goodman struck her with his fist, and that later in the day when her husband returned he was informed of the encounter. Tart said as a result of what he learned he crossed the street to the service station, the Tart s ore, op posite where Goodman was waiting on a bench. There both defendants agreed on one thing, “We went to gether.” But there were different versions as to who struck first. At one time Goodman said he was knocked into the grease pit by Tart even after Tart’s neck had been cut and blood was flowing freely before the fight was stopped. Following the evidence pleas were entered by both men as guil ty to engaging in an affray in which a deadly weapon was used. Judge M. O. Lee sentenced Good man to six months on the roads, for the affray charge, and six more for assault on Mrs. Tart, on the 'affray charge, the road term was suspended five years on condition Goodman stay off the premises of Pauline and Thomas Tart, remain of good behavior and pay the court costs. The assault charge was sus pended Uor two years on good be havior. Judgment against Tart was con tinued for five years on condition he not harm or molest Goodman, remain of good behavior and pay the court costs. Quinton Dllliams, 36 year old Er win father on Thursday in Har nett Recorder’s Court entered a plea of whipping his nine year old son in cruel and unreasonable manner. Williams told the court he was drinking at the time. Before the case was heard the tearful mother, who at one point appeared ready to faint, and the child conferred with Judge Lee in the judge’s chambers. The judge summoned the defendant to view the entent of the child's injuries which the boy said were adminis tered with a belt. A physician’s report, read to the court, reported multiple bruises on the left arm of the heid, left shoulder and back, and across the back to the waist. Judge Lee sentenced tlft father to 90 days in jail suspended on condition he not drink, not molest any member of his family. The costs were ordered remitted after the court, was informed the father worked for small wages and had the reputation of being a kind fa ther except when intoxicated. George Woodard, Lillington. Route 3, Negro, was found guilty of ssault. with a deadly weapon and; drew 30 days on the roads Frank Junior Bailey, Angier, R.' 2. Negro entered guilty to plea of j careless and reckless driving. He j had been cited earlier for failure to stop at the s»und of a siren and j speeding. He was fined SSO and j costs. Charges of assault, lodged against j J. C. Eason were ordered squashed j and prosecuting witness taxed costs! and fined ten dollars. Malcolm Byrd, who entered a guilty pleas to public drunkenness, was sentenced to ten days in Jail, i Byrd had been charged -with drunk and disorderly conduct, possession of whiskey with seal broken, re sisting arrest and breaking the glasses of the arresting officer. Charges of assault on a female were dismissed against William M Denton, Dunn. Route 3. Mrs. Den- j ton was taxed with costs after her I charges were found frivolous and | maliciius. Earl Gregory tendered a guilty plea to non support. He received 12 months on the roads, suspended five years on condition he pay $7.50 per week for support of his two children, age five and ten years, and his wife, Allen Gregory.
