Linwood Foust Says
Success Means Hard Work

Few people take the Horatio
Alger from rags to riches
story seriously, but Linwood
Foust, civil attorney in the
office of Brown, McCallum
and Foust, knows that such
things are possible and even
probable with the right atti
tude and hard work.
Linwood Foust graduated
from York Road High School
in 1963. “I was just an average
student, but I was a good
football player,” Mr. Foust
said. "I was not interested in
college and had not really
planned on attending, but I
received several athletic
scholarships.” ”1 guess you
could say my career was
somewhat guided by sports,"
the articulate Mr. Foust con
cluded.
Another reason Linwood
Foust felt that his chances of
continuing his education were
n't good was because of his
family income. His father was
an over-worked and under
paid truck drive who often
spent as much as sixty hours
on the job, but averaged about
$52 a week for his efforts. His
mother was a maid. Although
there was a great deal of
harmony and love in the
home, there was little money
and for Linwood Foust, little
hope of going to college. When
he received his athletic scho
larship to North Carolina
Central University, he decided
to accept it.
During his four years at
NCCU, his interest drifted
from sports to history, which
was his major. After his grad
uation in 1968, he was drafted.
He served one year in Viet
Nam. "It was then that I
thought about going back to
school. I had plenty of time to
think about it, so I decided to
go to law school,” Mr. Foust
said. He went to law school at
NCCU, and found studying law
fascinating. By then he had
met and married his lovely
wife, Phyllis, who was attend
ing NCCU’s school of nursing,
and fathered a wonderful
daughter, Phiderika. “Phyllis

In 1974, the struggle was
almost over. Both Linwood
and Phyllis Foust had grad
uated from their perspective
schools of learning and were
well on their way to establish
ing themselves and a good life
for their child.
Before taking the North
Carolina Bar Exam, Linwood
Foust worked at legal aid here
in Charlotte. His cases were
primarily civil ones, which is
perhaps why he today prefers"
civil cases to criminal ones.
He has established a few
major precedents through
certain cases such as those
that dealt with Homestead
Exemption, and saved quite a
few clients a great deal of
money with proper advice and
some counseling. “I under
stand the people who come in
here,” Linwood Foust said
reminicingly. "You see, most
of the people who have pro
blems with being cheated
businesses or organizations
are poor people-people who
do not know what their rights
are. I enjoy just taking the
time to listen to their pro
blems. Everybody needs
someone to talk to and some
times a lawyer can be a per
son’s best friend,” he con
tinued.

the Pennsylvania Bar Assoc
iation, the North Carolina Bar
Association, the N. C. Associa
tion of Black Lawyers, the
North Carolina Academy of
Trial Lawyers and the Na
tional Bar Association.
Anyone who believes that
hard work, hope and deter
mination only brings callouses
and weakened dreams has a
lesson to learn from Linwood
Foust. Horatio Alger he may
not be, but his story should be
an inspiration for all of those
who think you must be born
with a silver spoon in your
mouth in order to be able to
eat out of one in the future.

ity Center crowd.
