Zion Church will present a play on Friday evening, April 13 at 7:30 p.m. Entitled "The Lenten Story," the play covers spe cial periods in the Life of Jesus, from the time of His Baptism by John the Baptist through the Passion Week, Resurrection and His Final Commission to the disciples before ascending to His Father In Heaven. The cast is made up of the pastor and members of Hood and other neighboring churches. Rev. Roscoe Cousart, pastor of Hood and mlnlster-in charge, will portray the Lord Jesus Christ. Supporting main characters are: Jethro Mann as John the Baptist; Jaaon Adams as Simon called Peter; Clayton Cousart as Andrew; Samuel Cousart as Judas; and Oscar Reid as Pontius Pilate. The support ing cast includes: Jackie Bowens (Martha), Vanessa Bowens (Mary), Charles Reid (Sadduccee), James Reid and Anton l<espei (thieves on the cross), Abriel Reid (soldier), Goleen Reid (Mary Magda lene) and Susie Reid (angel). Betty Mann will be the narra tor for this special event. Special music will be provi ded by Johnnie Robinson and others of the cast. In his preliminary injunc tion, Judge James B. McMil lan stated that the state’s “deeming” regulation requir ing a spouse of a person in a nursing home to relinquish income to qualify the patient for Medicaid, most probably violates the federal Medicaid statute and the due process clause of the Constitution. Thp injunction came in res ponse to a class action lawsuit filed last tell by attorneys with Legal Services of Southern Piedmont (Charlotte) and Wake-Harnett-Johnston Legal Services (Raleigh) on behalf of two couples, John and Alma Foard of Huntersville, and Eddie and Lila Carter of Clay ton. To qualify for Medicaid benefits under existing North Carolina regulations, the non ins titutionalized spouse Was forced to contribute all but 1182 nf hit hr Haw mMiikli. Income toward! payment of the institutionalized spouse’s medical cost* "We were very pleased with Judge McMillan’s prelimina ry ruling,’’ said Lark Hayes of Charlotte who was one of the attorneys in the case. "In addition to being violative of the federal statute and uncon stitutional, we feel the state’s regulation imposes a very real hardship on families of nurs ing home patients.” Mrs. Lila Carter testified in court that she could not live on the $162 a month she had left after paying 9167 from her and, her husband’s combined in come to help defer his medical cost* Both plaintiffs said they refused to divorce or separate ! from their spouse and thereby free themselves of any legal obligation for their spouse’s medical costs. “I’ll eat grits and drink only water if I have to," said Mrs. Carter. "But 1 Road the Charlotte Post Mirh u/aalr won't leave my husband of 44 years.’’ In the preliminary injunct ion which waa signed on March 27, Judge McMillan ordered state Medicaid offi cials to stop enforcing the regulations. Under the injunc tion, Mrs. Carter will be allow ed to keep the $241 a month she receives, though thr $565 a month her husband receives in Social Security and retire ment benefits will continue to go toward his medical costs.£ Prior to Judge McMillan’s ruling, a bill was introduced in the General Assembly which would discontinue a spouse’s responsibility for his or her partner’s medical costs six months after the spouse enters a nursing home. Ms. Hayes says she does not support or approve of the six months provision. ”1 support Judge McMillan’s position which does not allow the regu lation to be imposed at all.” A final ruling in the case is not expected before next fall. Legal Services of Southern Piedmont and Wake-Harnett Johnston Legal Services are funded by the national Legal ^rvices Corporation to pro vide free civil legal assistance to low-income people.
