Bidders may obtain complete sets of plans and specifications for a deposit
of $300.00. Checks must be made payable to the Charlotte-Mecklenburg
Board of Education and delivered to the office of the Architect. Upon
receipt of deposit, plans and specifications may be obtained from Duncan

Individual drawing sheets and specifications may be obtained directly
through Duncan Parnell for a charge of $1.56 per drawing sheets with a
minimum purchase of (6) sheets, and $ .20 per specification sheet. Bidders
shall receive a refund of the full deposits if bidding documents are returned
complete and in good, usable condition with 10 days after the bid opening
date. These sets should be returned to the office of the Architect. Successful
bidders may keep their copies and will be issued a full refund. If bidding
documents are not returned to the Architect within 10 days after the bid
opening date, the deposit will be forfeited. The cost to Subcontractors and
to Prime Contractors for individual drawing sheets and specification pages
are non-refundable.

Bidders are also notified that they must be properly licensed under the
state laws governing their respective trades and that applicable provisions
of Chapter 87 of the General Statutes of the State of North Carolina shall

Sealed bids for the project entitled Water Treatment Plant Upgrade,
Town of Murphy, Cherokee County, North Carolina will be received by
Cherokee County at 2:30 p.m. local time June 8, 2004 in the Office of the
County Manager, 75 Peachtree Street, Murphy, North Carolina and
then publicly opened and read aloud.
THE PROJECT GENERALLY CONSISTS OF the upgrade of the
Murphy Water Treatment Plant including replacement of filter media,
.surface wash piping and sweeps, filter valve actuators, fiocculator drive
unit, backwash and high service flow' meters, and alum and caustic
metering pumps. The project also includes a new combined filter
effluent turbidimeter, streaming current monitor, laboratory
equipment, emergency generator, and automatic security gate. The
existing SCADA system will be modified as part of the project.

On May 19, 2004 at 3:30 p.m. local time, a pre-bid conference for
prospective bidders will be held in the Office of the Engineer, 55 Broad
Street, Asheville, North Carolina. The purpose of this conference is to
answer any questions pertaining to the scope and nature of the project
and to discuss the minority business participation requirements.
Prospective bidders are encouraged to attend this conference.
Bidders and other interested parties should note that prequalification of
equipment manufacturers by the Engineer prior to the bid opening may be
required for this project. Equipment prequalification requirements, if any,
are described in the Contract Documents.
A certified check or cashiers check payable to the Cherokee County or a
satisfactory Bid Bond executed by a corporate surety licensed under the
laws of North Carolina to execute such bonds in the amount equal to five
percent of the total of the bid shall be submitted with each bid.
The Owner reserves the right to waive any informalities or reject any or
all bids. The Owner reserves the right to award a contract to the lowest,
responsive, responsible bidder.
The successful bidder shall be required to furnish separate, 100 percent
Performance and Payment Bonds in compliance with North Carolina
General Statutes Section 143-129 and of Article 3 of Chapter 44A. The
Performance Bond shall be in full force and effect for one (1) year after
the date of final acceptance of the project by the Owner.
The bid deposit shall be retained by the Owner if the successful bidder
fails to execute the contract or fails to provide the required bonds, as
stated above, within ten (10) days after award of the contract.
Each bidder must be appropriately licensed as a Contractor in the State of
North Carolina as provided in General Statutes Chapter 87. Each bidder

This project is being financed in part by a grant from the U.S.
Environmental Protection Agency as Project No XP-97454902. Neither
the United States of America nor any of its departments, agencies, or
employees is or will be a party to this invitation for bids, or any resulting
contract. Procurement, however, will be subject to regulations published
in the Federal Register dated March 28, 1983 as 40 CFR 33.
Bidders must comply with the President's Executive Order No. 11246 as
amended, which prohibits discrimination in employment regarding race,
creed, color, sex or national origin. Bidders must comply with Title VI of
the Civil Rights Act of 1964, the Davis-Bacon Act, the Anti-Kickback
Act, the Contract Work Hours Standard Act, and 40 CFR 35.936 (F). A
certification by the bidder of prior work performed under Executive Order
11246 and compliance with 40 CFR 60-4 is required.
