Sealed bids for the project entitled Andrews/Murphy Water Connector
will be received by Cherokee County at 2:00p.m. local time June 8th,
2004 in the Office of the County Manager, 75 Peachtree Street, Murphy,

THE PROJECT GENERALLY CONSISTS OF the construction of
approximately 52,OOOLF of 12-inch ductile iron water, two (2) 300GPM
water booster pump stations, one (1) 200,000-gallon glass-fused-to-steel
water storage tank, and all accessories and appurtenances as described
in the project plans and specifications.

and to discuss the minority business participation requirements.

Bidders and other interested parties should note that prequalification of
equipment manufacturers by the Engineer prior to the bid opening may be
required for this project. Equipment prequalification requirements, if any,
are described in the Contract Documents.
A certified check or cashiers check payable to Cherokee County or a
satisfactory Bid Bond executed by a corporate surety licensed under the
laws of North Carolina to execute such bonds in the amount equal to five
percent of the total of the bid shall be submitted with each bid.
The Owner reserves the right to waive any informalities or reject any or all
bids. The Owner reserves the right to award a contract to the lowest,
responsive, responsible bidder.
The successful bidder shall be required to furnish separate. 100 percent
Performance and Payment Bonds in compliance with North Carolina
Genera! Statutes Section 143-129 and of Article 3 of Chapter 44A. The
Performance Bond shall be in full force and effect for one (I) year after the
date of final acceptance of the project by the Owner.
The bid deposit shall be retained by the Owner if the successful bidder fails
to execute the contract or fails to provide the required bonds, as stated
above, within ten (10) days after award of the contract.
Each bidder must be appropriately licensed as a Contractor in the State of
North Carolina as provided in General Statutes Chapter 87. Each bidder
shall make positive efforts to use small and minority owned business
enterprises on this project.
This project is being funded by a grant or loan from the North Carolina
Division of Environment and Natural Resources, Public Water Supply
(PWS) Section. All bidders are required to make good faith efforts to
utilize Disadvantaged Business Enterprise (DBE) businesses where feasible
for this project. The "Special Conditions Package for North Carolina Water
Supply Projects" included in the Contract Documents shall be followed by
all bidders. Any bidder failing to make a good faith effort to comply with
these Special Conditions will be subject to disqualification of their bid.
A conditional or qualified BID will not be accepted.
This project is being financed in part by a grant from the U.S.
Environmental Protection Agency as Project No. XP97454902. Neither the
United States of America nor any of its departments, agencies, or
employees is or will be a party to this invitation for bids, or any resulting
contract. Procurement, however, will be subject to regulations published in
the Federal Register dated March 28, 1983 as 40 CFR 33.
Bidders must comply with the President's Executive Order Nos. 11246 and
11375 as amended, which prohibits discrimination in employment
regarding race, creed, color, sex or national origin. Bidders must comply
with Title VI of the Civil Rights Act of 1964. the Davis-Bacoh Act, the
Anti-Kickback Act. the Contract Work Hours Standard Act, and 40 CFR
35.936 (F). A certification by the bidder of prior work performed under
Executive Order 11246 and compliance with 40 CFR 60-4 is required.
Bidders must make positive efforts to utilize small and minority owned
