This paragraph does not ap ply to or include strikes in effect prior to July 1, H22. "2. All men to return to work i:i positions of the class they origi nally held on June DO, i;i22, and at the same point. As many of such men as possible are to be im mediately put to work, at present the commission, hereinalter pro- vided for, shall be sufficient cause for dismissal from service. The Relative Standing '"i. The relative standing as be tween themselves, of men return ing to work and men laid off, fur- loujrhed or on leave of absence, in- cluJin(r general chairmen 'and others who were as of June 30, 1922, properly on leave of absence, will be restored as of June 30, 1922, and they will be called back to work in that order. "4. If a dispute arises as to the relative standing of an employe or if any other controversy arises growing out of the strike that can not be otherwise adjusted by the carrier and said employe or the duly authorized representative thereof, the matter shall be re ferred by the organizations parties to this agreement, the employes or the carrier in the interest of any employe who may be aggrieved, to a commission io ue esiaunsnea and constituted as hereinafter pro vided, for final decision by a ma jority voto. "5. The commission referred to in paragraph 4 thereof shall be composed of six representatives to be named by the chief officers of the organizations parties hereto and six railroad officers or repre sentatives selected from and by the railroad agreeing hereto. This commission shall be constituted within 15 days from the signing of this agreement and shall have jur isdiction to decide all cases that may properly be referred to it on or before May 31, 1923, but not thereafter. Compromising Controversy "6. inasmuch as this agreement is reached for the purpose of com posing in a spirit of compromise this controversy, all parties hereto agree that neither this settlement nor any decision of the commission above provided for, shall be used or cited in any controversy be tween these parties or between Jthe railroads signing the same, or any other class or classes of their em ployes in any other controversy that may hereafter arise. "7. Both parties pledge them selves that no intimidation or op pression shall be practiced or per mitted against any of the em ployes who have remained at work or have taken service or as against those who resume work under this understanding. "8. All suits at law now pending as the result of the strike to be withdrawn and cancelled by both parties."
