(919) 762-7762 PrCSS Clippings, continued from opposite It is also an explosive issue, because the concept of privacy was the basis of the Supreme Court decision that overthrew state laws against abortion — or, in Will's smarmy phrase, “the fact that in 1973 the Supreme Court discovered a constitutional right to abortion.” According to Will, “ Bork’s analysis is broadly majoritarian, deferring to the discretion of the community's popularly elected branches of government as they make choices about activities that shall be, on moral grounds, regulated.” That’s the problem with education: it lets fascists like Will cloak despicable thoughts in high-flying language. To translate his sentence: “Bork favors mob rule. He will not use the power of the Supreme Court to stop local governments from passing laws that impose the superstitions of ignorant but vocal pressure groups on the rest of society.” In particular, Will smacks his lips over the possibility that the Reagan court, under Bork’s leadership, will reverse the 1973 abortion rule: “His analysis is an intimation of how a reconstituted court could, on majoritarian grounds, disestablish some freshly minted constitutional 'rights’ and restore the community’s right to make moral choices.” Translation: If Reagan’s foreign policy doesn’t blow us all back to the Stone Age, then maybe his Supreme Court appointments will take us back at least a few centuries, to when straight white men made the moral decisions for everyone else. Will’s dismissal of “freshly minted constitutional ‘rights’” (he’s referring to the abortion decision) does not take into account any possibility that our concept of freedom and rights has grown over the centuries. But, cynic that I am, I believe there is such a thing as moral progress. The Founding Fathers, while very wise, had some blind spots: like their assumption that “citizen" meant “white male.” Over the years, America has discovered “new” forms of oppression — “new” because they weren’t understood before — and has worked to remove them. , One reason America continues to be great is that the American Revolution is not yet over. At any given time, there are still new meanings to be found in our basic concept of “freedom.” Once it seemed natural that blacks and women couldn’t vote. Now it seems unnatural. Now some think it natural that abortion and homosexuality are seen as “immoral.” It will not always seem so. The continuing American Revolution will bring us all our rights. Still, the revolution could be delayed by those who want to stop and even reverse our moral progress. A Reagan re-election and Bork appointment could delay our rights for another generation. But, hey, the man’s gonna make us all rich — at least until the deficit comes crashing down on us. And that’s worth a few decades of oppressive Supreme Court decisions, right? Wimps for Justice A few issues ago, we discussed one dirty rhetorical trick that the Republicans are using. Because the Democrats set up a quota system to ensure adequate representation of gays aqui lesbians within their party, some Republicans are trying to spread the fear that the Democrats intend to impose hiring quotas on all public and private employers. Unfortunately, the smear campaign is working. Evidence comes in a letter to the Columbia, S.C., State (8-21), from A.T. Chalk, who begins with the Democratic party rules and leaps to the incorrect conclusion: “It seems the Democrats intend to bring about legislation that would force gay men and women to be hired in the ’workplace.' A school is a ‘workplace.’ So is a hospital and the military.” Right. And gays already work in schools, hospitals, and the military, and everywhere else, too.
