The following is told of former Senator Joe Blackburn of Kentucky: In the days of his youth the Ken Juckian was asked by a friend to sec md him in a duel. He consented, ind at sunrise the parties met at the ippointed place. Now, it was this 'tentuckian's duty to say the last vords touching the terms of the duel. 3ut, although he faithfully performed Ihis duty, the duel never took place. A murmur of "Why not?" invari ibly goes around whenever this story is told, .whereupon the answer is as follows : "For the very simple reason. When Toe finished speaking it was too dark tor a duel." DEMONSTRATION FARM WORK Railroads Want Adjustment of Reguls tions Governing Mileage Book Tick et Windows Additional Postal Bank3 Established. Raleigh. The definite setting of the famous million and a half dollars dam age suit of Ware-Kramer tobacco com pany, Norfolk, vs. the American to bacco company, for trial at the May term of the United States court, be fore Judge Henry G. Connor gives this long-standing litigation an immediate interest and promise of speedy settle ment. The suit was originally for two and a half millon dollars for the destruction by the great tobacco trust of the business of the plaintiff in cigarette manufacturing business, first at Wilson and later at Norfolk, where the complaint is that the company was finally forced into bankruptcy by the relentless business persecution the American tobacco company main tained toward them as a business competitor. One million of the damages claimed was lopped off some months ago by a ruling by Judge Connor that the claim for damages must be confined to the phases of damages allowed under the Sherman anti-trust act, no punitive damages being admissible in such a case as this. The bill of complaint sets out about every phase of com petition that a trust is supposed to exercise in driving out competition, including contracts binding dealers in handle none of the goods of the plain tiff and spreading reports about the Ware-Kramer company detrimental to their commercial standing. One section of the complaint sets out that the plaintiffs shipped two carloads of cigarettes to China to fill orders re ceived and that the two carloads com pletely disappeared, never reaching their destination, an investigation showing that American tobacco com pany goods actually arrived in the stead of the Ware-Kramer shipment. They charge too, that the trust really paid the plaintiff for the two cars of cigarettes in question, the inference in the complaint being that the trust found through a sort of detective ser vice that the Ware-Kramer company had secured the big order from the Orient and set about to prevent its de livery and the substitution of its own goods. There was a draft attached to the bill of lading and this was duly paid and the Ware-Kramer company assert that they had no inkling of any "hold-up" in the delivery of their goods until their agent found that it was American tobacco company goods and not the Ware-Kramer goods that were supplying the trade that the two-oar shipment was intended to supply. Another remarkable feature of the complaint is that in which it is set out that W. M. Carter, as a secret agent of the American tobacco com pany, contracted for $10,000 stock in the Ware-Kramer company and was put In charge of the sales depart ment at a good salary and that they soon found that he was really knock ing the Ware-Kramer company in every way he could and decreasing their business and prestige as fast as possible. A subsequent order of the court had made Mr. Carter a party to the suit as a co-defendant with the American tobacco company. It was the Wsll3-Whitehead cigarette com pany that the American tobacco com pany used principally in fighting the Ware-Kramer company, according to the complaint. All the papers in the case have been carried by Judge Connor to his home offico in Wilson, where he is going through the depositions and putting the papers in order for the least pos sible delay In the progress of the trial when the case is called. The court will convene May 22 and the first week will be devoted to criminal cases. Then the Ware-Kramer com pany vs. American tobacco company case will be called and it is expected that something like a month will be required in the trial. Doctor Violatod Cattle Laws. In Wake superior court l3r. N. M. Blalock of Wake county was con victed of violating the state cattle quarantine laws by bringing cattle from Johnson county to his planta tion in Wake. The prosecution was by R. H. Battle for the state board of agriculture under the direction of which the campaign for the eradica tion of the cattle tick in this state is carried on. Judge Whedbee entered a nominal fine of $5 and costs against Dr. Bla lock. New Rural Routes Established. The postofflce department announces that three new free delivery routes have been authorized for North Caro lina, effective immediately. They are as follows: Angier, Harnett county, additional service route No. 2, length 17.33 miles, familes SO; Kannapolis, Cabarrus county, route No. 1, length 17.15 miies, familes 75; Wake Forest, Wake county, additional servire, rev No. 3, length 25.01 miles, families 150. Other routes will be established up on the proper showing to the post xo department ' Railroads Helping the Farmerf- There is to be a marked increase In the demonstration farm work dur ing the coming summer as carried on under the joint auspices cf the state department of agriculture and the railroad companies for th improve ment of farming methods in tne terri tory traversed by the various rail roads, especially the main haes. Last summer the Norfolk Soute"! led off in this work with farms established in eastern Carolina cn its lines, as i many as a half-dozen being established. now the Seaboard Air Line has just per fected arrangements for similar, co operative work between it and the state department of agriculture. The Southern has work of this sort ell established in the western section of the state, especially the Ashevxhe sec tion, with promise to extend it ere long into the central and southern sections of the state that this iine traverses. The state department of agriculture, in its co-operation in wcrlc of this kind, passes upon the types of soil to be used, the fertilization and the seed selection along with the methods of cultivation. The Seaboard has engagsd an ex pert to have general charge of this demonstration work on its lines aad he is expected to arrive very soon now. He will co-operate with State Agronomoist J. L. Burgess in locating the demonstration plats and the in auguration of the demonstration work. The wcrk of this kind by the Sou thern Railway company in the western section of the state is not in any way directed by the state department of agriculture, but the department is deeply interested in it and gives its influence to the success of the effort. Mileage Book Ticket Windows. The railroad companies are moving on the corporation commission just now for definite adjustment of the reg ulations fcr mileage book ticket win dows at a number of stations where more inhabitants as passed by the re cent legislature as a compromise in the fight that was made by traveling men for pulling mileage on trains. The railroads are asking the commission whether or not there must be two win daws at a number of stations where there are 2.0G0 inhabitants, but where the railroad companies claim that there is not the necessity for the double expense in sale of tickets The act is effective May 1. There must also be baggage checking regula tions for mileage by April 15. Elizabeth City Postal Bank. Postmaster General Hitchcock has designated 45 additional postoffices as postal savings depositories in as many states and territories, mostly at in dustrial centers where there are many wage-earners. Among the offices designated were: St. Augustine, FiBT Rome, Ga. Elizabeth City; Andenon, S. C, and Alexandria, Va. The Machinery and Revenue Acts ine printed revenue ana macim ery acts passed by the recent legisla ture in convenient form have list come from the state printers and irp being mailed to registers of deeds in all the counties in sufficient numtorfe for the county officers to be suppled so that they may be familiarizng themselves with the new features of the law which are quite important The machinery act, it will be remem bered, greatly enlarges the powers of the corporation commission as state tax commission, requiring the com missioners to go into every county and instruct the tax listers and as sessors in their duties and see to it that there is a more thorough equal ization of tax valuation as between counties. The commission is to ap point a county tax assessor in each county who is to supervise the worK of the township assessors and act with the county commissioners as county board of equalization. The corporation commissioners are allow ed an extra $500 per year each salary fcr the additional duties. Sentiment for Senatorial Primary. There is developing a considerable sentiment in favor of requiring a pri mary to settle the senatorial contest between Senator Simmons and Gover nor Kitchin and any other candidate that may get into the field. This will have to be called by the state demo cratic executive committee and be held most probably at the regular election in November, 1912. It is expected that the campaign activiti ties will very soon elicit from Gover nor Kitchin his formal announcement for the contest. Building Operations in Raleigh. -It is a notable fact that conserva tive estimate of the probable building operations in Raleigh for the present year, not including the $100,000 muni cipal and auditorium building now under construction rounded up $1, 137,000. Furthermore, none of the smaller building operations such as residences are included in this. It does include $200,000 for hotel facili ties assured and it includes the $250, 000 for a fireproof state building, and $60,000 for building at the A. & M. college. Demand for Farm Life Schools. Applications are coming in to the state department of education from very many counties of the state for copies of the act of the recent leg islature providing state aid for the establishment of county farm-life schools and the indications are that the limit of aid to ten schools es tablished any single year will be quickly taken up for the current year.
