A Bill to be Entitled "An Act to Issue Bonds For The Permanent Improvement of the Public Roads of Randolph County." The General Assembly of North n :.. j . varuuuH uo enacc Sestiou 1. That the board of commissioners of Kaneoiph Gounty De ana it is Hereby authorized, era powered and directed to submit to the vote of the qualified - electors of Randolph County, on any date after tne ratincatiou ot this act, and from time to time thereafter as in us discretion it may deem . best, the question as to whether or not the county of Randolph shall issue bonds iu sums not to exceed three hundred thousand dollars, in the aggregate, with interest coupons at tached, and levy special taxes to pay the bends and interest thereon, the proceeds of which said bonds shall be used for the purpose of opening, grading, making, improving, macad amizing, constructing and repairing ?ublic roads in KandcJph County, he said board of county commit siouers shall, for at least 30 days preceding tbe elect on, give public notice 01 sucn election, together, with the purpose thereof, by publi cation in one or more newspapers puDiuDta in said county: rrovid ed, that if theWicnty of the qual ified voters of said county shall not vote to issue bouds at tbe election so held, the said board of county vuiuiuiDBiuuers way Huumit me ques tion to the qualified voters of end county at any o ner time or times, under the provisions of this act. Sec, 2, 'JL'jat any election held under tbe provisions of this act shall be held and conducted iu the same maniier as is now or may hereafter be prescribed by law for holding elec tions for members of the General Assembly except as herein other wise provided. The board of coun ty commisdioneis sball appoint the regiatrara, judges of ' election, and any other election officers; that the registration and challenge of voters shall be conducted iu the same manner as is now provided for tbe election of meoitxrs of the General Assembly. And the said county commissioters shall order a new reg istration for any and all of said elections, lhat at the said elec tion or elections the ballots tendered and cast by the qualified voters shall have written or printed upon then "For Good Koads , or "Against uood Koads , and all qualified electors who favor the issuing of said bonds shall vote "For Good Koads," and all qualified voters op posed to the issuing of said bonds shall vote "Against Good fioads." The votes shall be counted at the close of the polls and returned to the Baid board of county commissioners on the Thursday next following tbe election: and said board of c ma ty commissioners shall meet on said day, of which said meeting no order or notice shall be necessary, and tabulate and declare the result of the election: all of which shall be re corded in the minutes of the board of county commissioners, and no other recording and declaration of the result of said election shall be necessary. The members of the board shall be entitled to the usual compensation for attending said meeting. The said deolaratioi of the result of said election as recorded in the minutes of the board, and al so such findings as the said board of commissioners shall cause to be en rolled upon its minutes relative to' the calling, notice, holding and returns of said election, which tLe said board is hereby authorized and directed to make after' considering the facts, after sixty days from such entry shall not be open to attack, but the record snail be deemed con elusive evidence of the truth thereof; subject only to the determination ot -any suit which shall be instituted prior w me expiration oi saia lime. The said new registration, required under this act saall apply only to the elections under the provisions of this act and shall in no way affect the present registration for county and state officers; and upon the con clusion of said election or elections, . tfhTofficers of said election shall re ' turn the registration and poll books to the board of county commission, ers to be filed in the office of the Register of Deeds for Randolph County. ' The fees to the registrars - and other officers holding said elec tion shall be one-half the fees al lowed by the : general election law. - 8eo. 3. In case a majority of the qualified voters at said election vote "For Good Roads" the board of commissioners of Randolph County is hereby authorized, empowered and directed to issue the bonds and levy the special taxes specified in this act. Eaid bonds shall be co tpon bonds of said county to an amount not ex ceeding three hundred thousand dollars, and in denomination of not lew than one hundred dollars, bear ing interest from the date of issue t a rate not to exceed five per cent per annum, payable semi-annually; eaid bonds to be of such form and tenor utd traefcrrie in stich way aci tic i'i'.z,it,A tola payable at such time or times not exceeding forty-one years from the date of issue, a id at Buoh place or places as the said board of county commis sioners may determine: Provided, that none of aid bonds shall be disposed of for less prioe than their par value and accrued interest. The said bonds shall be numoered and shall be signed by the chairman of the said board of county com missioners and attested by the Clerk of said Board with the coi porate seal of the county of Ran. dolph affixed thereto; aud tbe "cou pon shall bear the engraved or lithographed signature of the chair man of the said board ot county commissioners. Sec. 4. At the first regular monthly meeting of the board of commissioners of Ktndolph County held after said election, the said board shall elect one elector from each township of said county to be known as the Highway Commission of Randolph County, whose terms of office shall be for two years or until their successors in office are elected. And tne eaid Highway Commission shall have power to fill all vacancies by death, resigna tion or otherwise, for any unexpired term. That said Highway com mission shall meet at tne courthouse in Asheboro on the first Monday alter tUeir election and orgauiza by electing one of their number chair man aud another clerk, and all their proceedings shall be by said clerk recorded m a book to be pro vided for said purpose; the said cUrk shall deliver said book to the secretary for the executive commit tee htrdinafter provided for who sha'l record the transactions of the latter named committee in the name book. Sec. 5. At said first meeting of the Highway Commission it shall select fire eiectoi s, residents of said county, as an executive committee to have cnarge of and .look after tbe working of tbe said roads; that two members of Baid executive commit tee sball be elected for two years; one for three years, and two for four y-ars, and until their successors are elected and qualified; and tbe said Highway Commission enall have power to fill all vacancies of tbe exe cutive committee by death, resig nation or otherwise, for any unex pired termc; Provided, that at least two members of said executive com-, mittee of fluid Highway Commission shaL at all times be members of a different party from that cf a ma jority of the said board of county commissioners, said two members to be selected from the political Dirty casting the next highest vote to that political party electing a majority of said board of commissioners at the last election held for the elec tion of county officers. That as soon as practicable after the elec tion of the Baid executive committee of the said Highway Commission the said committee shall meet and organize by eleoting one of fieir members president of said executive committee, another of their members secretary, and some other suitable person, not a county officer, treasurer thereof; and shall pass such rules and regulations for their govern ment as they shall deem best: Pro vided, that the members of the Highway Commission and of the ex ecutive committee thereof shall take an oath before some person author ized to administer oaths, to Derform the duties of their respective offices to the best or tbeir skill and abilitv: Provided further, that as the terms of office of said Highway Commis sioners snail expire, the board of commissioners of Randolph county shall elect their successors te same for a period of two years; and when tbe terms of office of the said ex ecutive committee shall expire the said bighway Commission shall elect their successors for a period ol four years eacn. Sec. 6. The said Commission, at its nrst meeting snail suggest and recommend to the executive commit tee thj various public roads in the county wmcn should be improved with the funds hereinafter provided for. They shall likewise suesrest and recommend the character of work to be done on said roads and the number of miles to be covered. A copy of the minutes of the said meeting, setting forth the roads to be so improved and the number of miles and the material intended to be used, shall be furnished to the executive committee and the road engineer to be elected by said - exe cutive committee. The . road . en gineer and his assistants shall make a careful survey of the said roads, under the direction of the executive committee, and he shall make re port as soon as possible after ac complishing said work to the . exe cutive committee of the said High way Commissisn, and in said report he shall give an estimate of the cost of the work proposed to be done on the vsrious roads suggested. As soon as said report shall have been presented to the president of - the executive committee of the Highway Commission he shall call together tne executive committee to meet in Asheboro within ten days, mailing notice to each member of the said committee at least five days . before the date fixed for the meeting. At tbe said meeting tbe executive com mittee shall take final action in the premises and shall select the public roads to be improved and designate tbe number of miles ou each road and the kind of material to be used, and they shall appropriate to each separate road so selected the sum of money estimated for eaid purpose, and no more; and thereafter if the money appropriated for eacn separ ate road shall be inadequate for the purpose intended, no more funds of the said bond issue hereinafter pro- vided for shall be expended on said road, except that the executive com. mittee by a four-fifths vote may ap. propriate such further funds as it sball deem necessary. Tbe said exec utive committee shall designate tbe width of the highways to be con structed under this act. Sec. 7. Tbe said HighMy Com mission shall meet once each year, on tbe first Monday lh January, and it shall likewise meet at such otbtr times during the year as the presi dent of thfc executive committee or the chairman of the Highway Com mission, and five m.mbers of the Highway Commission shall de signate upon live days' notice in writing duly given to all members of Baid Commission by letters - ad dressed to their usual postoffice. See 8. That the said executive committee shall not receive compen. sation for more thn three days ser vice in an; one month, and their pay shall be the same as is now re ceived by the commissioners of the county, and the members of the Highway Commission shall also re ceive the same pay as is now provid ed to be paid to the couuty commis sioners for one meeting in each year and for not more than one call or special meeting: Provided, that the executive committee may employ tbe president or other member f tbe executive committee to devote more of his time than three days per month and that he be paid the same as is now received by the commis sioners, of the county, and also bis expenses for sue J time as the execu tive committee may deem best to so employ him. Seo. 9. By a twe-'.hirJs vote of tbe Highway ComraiosioU a vacancy may be declared in the said executive committee and a Dew member elected to fill Buch vacancy. These vacan cies may be created at any time in the discretion of said Highway Com mission. - Seo. 10. That the Baid executive committee may in its discretion .es tablish a chain gang in said county under the 1 w, for working and im proving the roads of Randolph county as provided for in this act, and BhaU have entire charge and control of tbe chain gang and of all other pri loners convicted of crime and sentenced by the court or courts to penal servit ide on tbe said public highways. It shall elect by ballot a highway superintendent for Ran. dolph county, and fix his compensa tion. The person so elected shall take and subscribe an oath for tbe faithful performance of his duties as highway superintendent and shall execute an official bond in the sum of two thousand dollars for the faith ful performance of his duties and for accounting for the money and property which may come into his hands as said suptftntendent, the bond to be approved by the executive committee; he shall bold office tor one year or ' until " his successor is elected and qualified, except that tbe said executive committee may re move said superintendent from his office and elect a successor for the unexpired term. He shall ' enter upon his duties and work when and wheie directed by said executive committee he sball supervise the laying out of the highways selected by the said exeoutive committee; under the direction of an engineer experienced in said work ; he shall have control over and direct tbe workings of the convicts in Ran dolph county, and shall also have control over and direct all other la bor as may bj deemed by the execu tive committee proper to be employ ed t n said road ; it shall be his duty to employ the overseers of the chain gang cf the convict force, and over seers of such other force as it may be deemed by the exeoutive commit tee expedient to employ, and the necessary servants aud guards and for working and caring for the con victs nnder ana by authority of law. He shall prescribe the .duties of the said overseers, guaras and servants, and may remove any of i ny of tbem at any time; all of which duties uf the sa d superintendents shall be subject to the approval of the execu tive committee. . Sec. 11. That : the treasurer of the executive committee shall ac count to ; the executive committee twice annually for the said highway fund, and as much of tener as the said executive committee shall deem best. His compensation sball be fixed by the committee. The said executive committee may require aa often as they think best reports from officers and employes concern- The Cause of Many Sudden Deaths. Sec. 13, The said executive com mittee, in determining upon the said roads to be made or improved witnin said county snail take into consideration the needs of the entire county and every part thereof with special regard to a complete system of roads which in their opinion will be of benefit to the greatest number of the people of the county and treating every section of tbe county with as equal favor aud justice as may be possible. ' Sec. 13. In relocating, straight-' ening or widening roads now in use or in opening new roads the execu tive committee may cause a survey of tbe proposed change, of an old road or of the new rou to be opened and if they adopt said survey they shall give notice to the owner or owners of the land that they have adopted said survey or surveys and that the same is condemned for the use of the county for a public road. Any pei son wha shall obstruct or hinder an authorized person in making a survey ; for the changing oi a road or the opening of a new road, or shall obstruct any one in the performance of the duties or work specified in this act, shall be guilty or a misdemeanor ana nned or im prisoned or both in the discretion of the court. And whenever the exe cutive committee or its agents can- nji agree wun roe owner lor tbe purchase of any gravel pit, stone quarry or any gravel, stone or other material needed in the building or repair of said roads or for land for crusher plants or convict cam psr it shall Have the right at any and all times, to enter upon said lar-ds,: premises or property or to have its agents, employees or contractors to enter thereon and take therefrom any stone, gravel or other material wmcb shall be needed for said pur. poses or to erect, maintain and oper ate crusher plants or convict camps on such lands, as long as may be neeatui for tne purposes of this act: Provided, that any person who shall have sustained any damage or injury te his property by any act authoriz ed by this section, may within four months thereafter petition the board of county commissioners who shall cause the. sheriff of the county to summons a jury of three disinterest ed freeholders to assess the damages to said property owner or owners.
