Mrs. '.-Stewart, wife of1 "the owner

awakened by the noise or whoever, was
taking the car from the garage and
that as the car drove by the house she
looked out of the window and recognis

of another 'automobile, coming down
the road. Several witnesses told of fol

Skeen some miles away,' and finding
the car In his yard, near the end of the
house and that Skeen came out within
two minutes 'after being- called, fully

a good character during the 18 months
he lived in that community and also
by witnesses from Randolph county
where he was bom and formerly Uvea.
It was also contended by the defense
that it was a misty night and that the
window glasses were cloudy and that
Mrs. Etewart was mistaken la saying
that it was fflcm. Lkeen appealed to
the Supreme Court, Judge Findley
placing the bond at $5000. ; .
