The New York World says, with great truth: "Whenever a 'statesman.' in or out of Con gress, t9 especially ireriomous against newspapers, one or two things is pretty certain: Either the newspapers have exposed him in something discreditable or he is afraid of being exposed." This deserves to be taken to heart. "Statesmen," in or out of Congress, who have writhed undefthe deserved lashings of the pies, or who vish to dis count the effect of the lashings they are to get, often affect to sneer at it, using such terms as "little newspapers," and the like, seeking thus to belittle the agency which holds them to ac count. The people should know that the newspapers are the best friends they have. There is less corruption among politicians; and the cry of "subsidized press" from whatever quarter it comes, is the cry of the purchasable, who are afraid to have the search-light turned upon their own deeds. There is no reason why any citizen of average intelligence should not be able to discrimi nate between the newspapers which are honest and conscien tious, which have a proper con- ccption oi tncir public responsi bilities and are striving in good 'faith for the promotion of the general welfare, and those which are in the market lor illegitimate f3 ' a . T J jrc-c f tl. fi rot class deserve the confidence and defence of the people, for these are theirsurest bulwarks, and the man who would decry them may well be regarded with sus picion. They haye put in jails and penitentiaries many of those who have been loudest irr denun ciation of them, and driven many others in disgrace from , public position. True, the bachelor becomes on his marriage, if not an object, of commiseration to the knowing ones, an object of comparative indifference to all women but one; but the superior love of that one atones for all and his added dignity and completeness as a man and citizen make h;m won der how he previously existed as one half of a pair of scissors without the other half. Fuller, Convict ed of the murder Jof Parker. - - The newt'riaf ws granted on the following grouqds: First, that the Judge erred in allowing the State to challenge a juror peremptorily after he had been tendered to the prisoner. proviso in section 1,200 of the Code requiring that such chal lenge be made before tender. Second that the Judge erred in holding that an affidavit to the effect that a juror had falsely sworn that he had not formed and expressed the opinion, that the prisoner was guilty weuld not warrant him in the exercise of his discretionery power in set ting aside the verdict. Third that the court erred in instructing the jury that . when the prisoner was indicted under the act of 1893, the use of a deadly weapon raised the pre sumption of premeditation. The Court holds that it raises the presumption of malice only, and in the absence of actual proof would raise the presumption of murder in the second degree only. April 10th, at 10:30 o'clock of hemorrhage, at the residence of his father-in-law, O. H. Owen, No. 114 Church ayenue. He was a carriage painter and a fine workman and was 53 years old. He was born in Fayette ville, N. C, of which city his father was once mayor. He re sided for some years in Savan nah, Ga., where he was a mem ber of the Masonic fraternitv ana .ea ivieu. iie was a mem ber of the Methodist church and was highly esteemed by all who knew him.
