Jude Ilradley tliis morning rendered a decision refusing a writ of mandamus to Geo. T. I'ullas kio to compel the civil service commis sion to approve his reinstatement as a substitute letter carrier. I'ullaskie passed the civil service exam ination for the position anil, August, ISU2, his name was placed on the eligi ble list for appointment. January 23, 1K03, Postmaster Sherwood of Wash ington made a requisition upou the civil service commission for a candidate for appointment. This list as forwarded included I'ullaskic's name anil he was selected and received notice from the postmaster of hisnppointmcnt. He was dropcd from the rolls by direction of the postmaster general under instruc tions of the civil service commission that the appointment was irregular. i 'ullaskis contended that he was un lawfully removed from the position and applied tor a writ ot mandamus to cumin-1 the postmaster general to reinstate him, the com nission to approve tbe re instatement.
