Mr. Burnet t won the heart s .T his little
flock and the fiieudship ami atlmiratinu
of every one who knew him, nl whatever
denomination. And this estimati in of
the godly man has always heen held by
the people here, vh;. have known him
closely through .ill the changes in years.
At three dilkrent periods of his lii'e -Mr.
Burnett was stationed at Ashevillc.
With the exception ot u residence in St i.r
tanburg, during a portion of the war, he
spent his lite here, his home being the
place now owned by C. S. Cooper in
Ratnoth.
Mr. Hurnett w as married four times.
His first wife was Miss Mary Kllza Alex
antler, an aunt of Col. (. M. Uay nl Ka
moth. She died in lsiio. His second
wife was the widow of John V. W.iodfin
ot this city. His third m u ii. me was to
a Miss Tucker ot Stat esville. lbs fourth

They had not been approached or tun
peied with in any manner and there had
been no improper conduct whatsoever,
line juror had taken three drinks of
whiskey during the trial and another
had held whiskey in his mouth at one
tone while suffering from toothache.
None were under the inlluence
of whiskey in the slighest degree; the

interested on cither side of the case. The

night while sleeping and during that

by the jury until alter the judge's charge.
Judge Jones said that he was satinied
t hat t here had been no improper con
duct indulged in by thejury, and that if
it had appeared that any member had
been under the inlluence of whiskey he
would not have hesitated a moment to
set aside the verdict.
The motion lor a new trial was over
ruled a ml the solicitor asked the judg
ment of the court.
Mr. A lams made a plea for the- mercy
of the court in the sentence and staled
that he did not believe the prisoner of
sound mind.
Clerk Young and I'r. li. V. Cooper
testified that t hey had known Harper
many years and they believed him to be
but little better than insane.
The judge said that he had been im
pressed by Harper's demeanor during
ll'.e prisoner's presence in court thai, he
was nut of strong mind and that in view
ol all the circumstances and the recom
mendation of the jury he would make
the sentence seven years in the peniten
