upon the false accusation that he was a
fugitive from justice, and it is more than
likely that lie will be promptly returned
to this State. From Captain W. B. Ken-
drick, now of Raleigh, but formerly of
Virginia, vour correspondent learns that
Mr. Hewitt is a son of Dr. Hewitt, whose
home is near Lynchburg; that he is an
A. M. of the University ol Virginia, and
that both he and bis father are gentle'
men of high character and means. Mr.
Hewitt has done a great deal for the de
velopment of this State. He has been a

Ben Smith, town ruusbnl, testilied
that he heard report of firearms at house
of J. R. Sams; found Willis Morgan lying
in the walk between the gate and the
house. He died in a few minutes, went
on to house of J.R.Sams; he told me
part of valor he stood. One of the party
pulled the bell cord, the train stopped
and they were oil and in tbe woods in a
jifl'y. And the train proceeded on its
way.

The Suspended Cable's Work. Diiw s,

eight passengers the suspended cable
car dashed down its steep cables a dis
tance of UOO feet yesterday allcrnoon,
and, drawing up with a terrific shock,
threw its passengers on the car lloor, in

Dr. John H. Baird testified: The pis
tol that Ben Smith said was found in
Morgan's hand in J. R. Sams' yard was
my pistol. It is a self-acting heavy
nickel plated 38 calibre. I do not know
how he got it.
Miss Mav Baint' Testimony.
Miss May Sams, aged 14 years, daugh
ter of I. R. Sams, testified: Last Tues
day morning, Feb. 13, Morgan wrote
me a note asking me to get ma to let
him come to sec me. Pa and ma gave
their consent and he came up to our
house at 4:30 in the evening. As soon
ns he came I smelled the whiskey on him
and told bim 1 could not have anything
more to do with bim. He would then
cry awhile and curse awhile. He told

no more to do with him I should never
have any more peace nor any otner mem
ber of my father's family. He took out
two pistols, but put one dock into ms
pocket. He had a knife open in his coat
pocket. He said, " my soul, if I
could not kill both of us. As you are a

shall never ue happy." He then put up

Episcopal church, the new edifice to be
built by Kcv. II. S. McDufl'cy's congrega
tion, will be laidThursduv of this week at

Asheville men. The public is cordially

The new church will stand at the cor
ner of Valley and South Beaumont
streets. It will be built after tbe model
of Trinity church on Church street, 9G
feet long, 32 feet in the nave and 48 feet
in the transepts. It will be of brick and
