At the mri-liug o( membersol the Ashe ville bar yesterday afternoon in memory of the late Mai. A'. H. Malone, w hich was attended by L'o or 30 lawyers, the following were the resolutions adopted: That while we bow with reverent submission to the Supreme will, we mourn the loss ol a lawyer ot great learning and ability, an author of dis tinction, a citizen of broad and patriotic ideas, and u man whose courtesy and unspotted integrity won for him tl.c love and admiration of us all. "That the sympathies ol the members of the bar be extended to bis bereaved family. That the ludge of this court order these resolutions to be spread upon the record ol this court and lint the same he published in the newspapers ol the city. These paragraphs arc Irom the re marks made bv some eif the law vets who poke to the resolutions: Capt. M. li. Carter: "Maj. M.tl.ine was always rcaov to conceuc every uung that one lawyer couhl concede to an ther, lie was always polite and cour teous. 1 here was no more nonesr. man in the profession. 1 shall always hold his memiirv in revcience." Hon. las. 11. Mcrrnuon: "lie had many of the qualities ol mind and heart that 'made a creat and good man. W'hat- ver view he took oil anv question he was ntirelv honest in it. He was always readme' and stimu li: and had dune much sensib'e wntpc. lie left two b uks that in time will rank among tl e lust law hooks of the country. He did i great deal ol charity work lor people who were unable to pay. and, another thing, he never knew how to charge for his work. His lees were small. 1 nc morel was associated with hmi 'he more 1 learned to love him." Locke Craig: "No man had more af fection for the younger members of the bar. In many respects he was a great man. lie always iiied a ease on its merits; not oil its U ehnicaiitics." j. M. t'.udger. in a talk abounding ill praise ol the dead lawyer, related an in cident as going to show one phase of Mai. M.iloiie's eh.nacter. i was ill the Ku 'Klux times, and in Madison county. An old colored woman, supposed to be a witness in Ku K lux cases, was found murdered, and it was thought she had been nur out of the wry on account of her iinlciice. I'm a chain of circum stantial evidence was torged around a colored man named I'ucker, who was arrested. When brought to trial Judge Henry asked w ho ol the members uf the bar would undertake Pucker's defence, us the darkey was poor and could pay no fee. Mai M. done arose and pulled Mr. Oudger with him and thev agreed to un dertake the defence. A little later they went to another place to consult with Pucker and get at the truth uf the case. The man niter being repeatedly urged detailed to his attorneys Ins connection with the case. It was us horrible a miir der storv, Mr. t'.udger, as he had ever heard, even in a court room. I uon hear ing it AI.iJ. Alanine spuuc strongly in lying up the defence ol the guilty wrcicn and unlv alter a long argument with his ass iciate counsel would he refrain from going into court and announcing his withdrawal from the ease. Mr. C.udger, in his talk, did not give the termination ot the case, but he told The Otizkn that Pucker was convicted, the Supreme court granted a tiew trial ami penning that he escaped and has never been heard of. I'.cn. I lii-o. 1". Pavidson ; "He was a man 1 liked personally exceedingly. Two qualities stood out pre-eminently : his moral courage and his power of research. The book he wrote is one of the most valuable to Noith Carolina lawyers ever written. He was a genial companion, an honorable In other, and we all lecl we have lost an estimable friend." Thos. K. K tnsotn : "His life as a man. a citizen and a lawyer, was above re proach." Judge Jones: "The first thing that immcsscd tnc was his courtesy, and es pecially to the younger members ol the bar. Another thing, he always had sMiipathy for the under dog in the light And whenever he made up his mind whatever other men thought was n mat ter of indifference to Inm. Due reason w hy he did not achieve greater success was his modesty. His prolcssionn! hie can be held up as a model to the young members of the bar. The foams Amtuclallon In Mca Ion al Hilimorr.
