'Taylor, boy of II or II years of age, la seeking to re cover damages from Mr. Ilambey for whipping alleged to have been sus tained by the plaintiff two years ago while In school, at one of Ashevllle's publio schools. Mr. Hainboy, who was principal of the school at that time, thrashed the small boy, It Is alleged, for holding and kissing a girl, one of the student In the school. The plaintiff asks for damages HitioimtlnK to M.VOO on the charge thut the hoy was cruelly whipped by the defend ant The case was first taken up In police court, where Mr. Hnmliey was convicted and fined, but took nn ap peal to the Buperlor court, where It was not proased by the solicitor. Mr. Hamhey, who was formerly principal of the Asheville high school, resigned from that position about a year ago and entered business with the firm of MuBtin-Koblnson of thin city.
