Judxe Charlton had named a re tervier W. V. Davis, and Judge Spier named United Slates Marshal White 88 receiver. Judge Charlton refused to recognize the Jurlmlli lion of fed eral officials and ordered his re ceiver to refuse to obey Judge Speer's v.rlt. Thereupon, Judge Speer tiled la ja for contempt. Judge SK-cr Conciliatory. Today Judge Speer proposed to Judge CharMon. that 1 he vould hold Intact all the company's prop erty until the state Supreme, court could pass upon the question of juris diction, the citation for contempt would be recaillod. Judge Charlton wired that he would agree, and Judge Speer telegraphed back: "Your telegram received. Rule ya'lnst receiver accordingly suspend J." DEA TH OF OFFICER PROBED Second Court of Inquiry Order ed to Investigate Shooting of Officer at Naval Academy Two Years Ago. (Special to Hie Illen WASHINGTON. July 10. The navy department yielding to the long anil persistent efforts "f the mother of I. hut. James M Sutton, who was Killed under mystirlnu.s circumstances it the Naval academy at Annapolis. In October. 107. has finally deter mined to investigate the caw further. and has accordingly appointed a sec- mil court of impilry for that purpose. At the court of iiHiiiry held Immedi ately after the tragedy the de Islon was gitven that the young lieutenant had come to his death by Ills own hand. Mrs. Sutton finally presented the affidavit of the chauffeur who had driven Lieut. Sutton and two fellow ifficers on the night of the tragedy which threw u new light on the affair. and It was on these that the depart ment finally took action. Members of Court. The court of inquiry will be com posed of orninodorc John llooii, ftia- or W. C. Neville, of the Marine corps, Lieutenant Henry M, JeriKlns and Major Henry Leonard, of the Marine corps, as Judge advocate. At the original Investigation into ,ieutcnant Sutton's death, held in October, 1907. shortly after the event. the only witnesses examined were Lieutenants Hubert K. Adams and Kd ward P. ltoclker, who were among his companions when the fatal bullet was fired. They testified that he shot himself, thinking lie hail killed Roel ker, with whom he had been uarrel Ing. Chauffeur's Statement. The chauffeur's affidavit says: "On the night of Lieutenant Sut ton's death, October 12, 1907, I was busy with my machine on account of a dance at the academy. Around mid night 1 was atCarvol hall. A number of people were around the hotel and a parte nf .maniaa rfH-" n had a room where they had drinks served. Lieu tenant Sutlon was not a member of this party, but he was upstairs in the hotel with some other people. "About Il'.IS, or maybe 12.:I0. he asked me to take him up to the bar racks. I told him that there were three officers going up in a f.w min utes, and asked him to wait. He said ' Alliight, we'll all go tip together.' "When we got to the dump Lieu tenant Adams pumped out, and said " 'Sutton, you've got to tight!' "Sutton and the other two officers got out. and Sutton said: " 'I have got nothing to fight about "He took out some money and paid me for the fares. Just them Lieu tenant Adams perked off his coat. and. throwing down his hat. made a rush for Sutton. Sutton stepped to one side, and I heard him say: " 'Oh, Til fight. If It is fight you must have!' "Lieutenant Adams then made an other rush and the two offlcers grab bed, Sutton., one by each arm. Then they ordered me to 'beat It.' and 1 started up my machine and went away. I heard no pistol shot nor did I hear any outcry. "The next day I heard that Lieu tenant Sutton had lieen found shot through the head. It was said at that time that I had been spirited away from town, but have never gnc away. They did not send for me at the first Investigation, and I have never been asked to tell the little I know until lately, when Mrs. Sutton mine to see .lie. Jealousy the Cause.. Jealousy is now believed to have been 1 ha cause . of the shooting of Lieutenant Sutton, from friends of the dead youth It Is learned that Sut ton and an officer who was with him on the last night or bis life bad been especially attentive to the same young woman. Her testimony Is expected lo show that she bad cast aside the rival for Sutton.
