Bond, 8peeial Judge appointed, personally appeared Duck Cofiield who complains and gays that John Roger so a did, on the 23th day of Dec, 1891, ma liciously and with malace aforethought interfere with pleasures and enjoy ments of Christmas holiday in violation of special ordinance grantiug same of the town of Edenton contrary to the statute in such case mide and provided and against the peace and dignity of the State. THE TRIAL : Promptly at the hour appointed the eomrt room (the judge's office) was filled with anxious specta tors t&ndliu the prisoner was brought in by the Officer who had ae suc cessfully served the pa pers and made the ar rest. In the absence f the State's Conn sel the Judge read th complaint and warrant, the Attorneys announced the faet that they were ready for trial, and witnesses wero called, when all an swered except J- C. Finch, who was fined ; however he 44sho wed-up" in a few momenta and was excused. The plainifTs Attorney John W. Branning, re-read the warrant and entered into the trial with a determi nation of convicting the prisoner. The prisoner was restless, nervous and much excited, so much so. that at almost every seoond ho could be seen whispering into the ear of his ft- Smallest Hair Throws a Shadow: " N. Ihe witnesses were about to be sworn, when the consoienoe of the criminal gave way, and without again consulting his protestor, he in a loud and trembling voice exclaimed "stop! I sub mit the case," whereupon his counsel raised to his feet, and in a mild, elo quent and plaudable manner plead earnestly for the mercy of the court, declaring that his man was ignorant of the law. Branning, with hair pushed back, with sleeves' relied up, with his head e&ecked, and with a faee that gae expression to "every word uttered, arose and addressed the court bringing applause from everyone present He showed that Ignorance was no ex cuse in law. . He showed" that the act was done willfully iuid maliciously against the peaee and dignity of the State, and after reading a tew pas sages of "Almanac law" closed his remarks by insisting that the prisoser be dealt with severely, saying that an example should be made of this criminal and he bo heavily., fined, applause. Judg3 Borid asked the prisoner to stand up, and in the presence of the vast assemblage reprenianded Roger son and to the clerk saldi; It is con sidered and adjudged that tbe.de fendant is guilty and that he pay the costs for his conduct.
