(Wilmington Dispatch.) The most interesting feature of today's session of the United States Circuit; Court was the handing down by Judge Purnell ot a decree-for the sale of land in Dare county. There are 150, 000 acres in disoute u it is - A said that the sale w.i. be the largest land sale ever made in this State. The laud has been in the courts for the last Hve or six years. The decree fol ovvs: United States of America, pas tern District of North Caidli na, in the Circirt Court iu equity: East Coast Cedar Company vs. People's Bank of Buffalo, N. Y.: American Exchange Bank of Butfalo; W. A. Ensign and Charles A. Ensign, trading as W. A. Ensign & Son; M. H. fi own, Bank of Com merce, in Buffalo, N. Y., by Henry H. Parsons and John R. Hazell, receivers, and the Phoenix National Bank of New York, defend ants. This cause coming on to be heard, and being heard on the depositions and other proofs, after arguement by counsel both for petitioners and defendants it is now considered, adjudged and decreed: (1) . That the land described in the petition cannot be actu ally divided without great cx pense and injury to the tenant in common interested. (2) . That said land be sold at public auction, at the court house id Manteo, Dare county, N. C, after advertising the same or thirty days in some news- m . a - 4 paper published at Kaieign, Norfolk, Baltimore, New York and Elizabeth City, said land may, ai tne commissioner Here -j . m mm in named deem the same feasi ble, be divided into five lots, by taking tl.e natuial and estab lished points on Alligator River to the natural marks on the op posite boundary and estimating the area oi such lots. That, af ter selling or ottering said lands for sale, in lots as aforesaid, the commissioner shall offer said land as an entirety; and report both sales, as in lots and as an entirety. Parties bidding tor said land shall, within ten days, deposit in the registry of this court, per cent of the bid made foi a lot, or the whole of said land, or a certijjed check for such amount. That A. B. Andrews, Jr., Esq., of Raleigh, be and is hereby appointed commissioner to ex ecute this order and deciee. This cause is held tor further orders. THOS. R. PURNELL. U. S. Judge, etc. June 28th, 1900. This is the same property that has been in a levy litigas tion in the courts of N. C, be tween the Buffalo City Mills and these Banks, who held mort gages upon the same for over one hundred thousand dollars. Andrew Biown the bankrupt lumberman, of 25 Whitehall street, New York City has been manipulating this property for a number of years past. This is a great legal victory for the attorneys who represent these banks who are represented by Messrs Prudeu & Pruden, of Edenton, Sheperd & Busbee, oi Raleigh, Norris Morey, of Euf falo, N. Y. over F. H. Busbee and E. F. Aydlett of counsel for the East Coast Cedar Co., or Buffalo City Mills: Andrew Brown went into voluntary bankruptcy for 858. coo in the U. S court at Trenton N. J. and his discharge is now being contested by these banks and other creditors on the grounds of failure to disclose all his property inteaests, they claiming he is the virtual own er of the East Coast Cedar Co. or Buffalo City Mills in North Carolina. Mr. William Merrit, Sr., de parted this life at his home a few miles from Edenton, Thurs day, June 28th., The burial ser vices were conducted by Rev. G. N. Cowan. The remains were laid to rest in the family butying ground at Macedonia church. He leaves a wife, nine children, and lots of relatives and friends to mourn their less. Peterson and little daughter, Lucie, arrived home Tuesday, after a pleasant stay with relatives and friends in Hertford. Ezekiel GlMfAN. Residents of this and adjoin ing counties will learn with re gret of the death of Mr. Ezekiel Gilman, of this place. Mr. Gilman was probably one of the best known citizens of Currituck county. He was born in Newburyport, Mass., but removed to North Carolina at an early age. For many years he taught school in the counties of Pas quotank, Camden and Currituck, and many of our most promi nent citizens today were his pupils. He was a graduate of Harvard College Cambridge, Mass., and at the time of his death was probably the oldest living grad uate of that celebrated institu tion. For the past few years Mr. Gilman has been unable to teach owing to a slight defect in his hearing, but he retained the use of nearly all of his faculties up to h death. Mr. Gilman was always inter e sted in any question of public policy and in a conversation held with the writer a few weeks ago showed he was fully abreast of the times, by discussing vigs orously the new State amend ment and the foreign policy ol our government. He was a singularly well posted man. Mr. Gilman passed away in the 83rd year of his age and he will ceitainly be missed by his many friends. Dorothy. A Good Cough Medicine. ELIZABETH CITY, N. C June 30th, 1900. The Democratic County Con vention was called to order at the Courthouse at 2 o'clock p. m. by Hon. J. B. Leigh, Chair man of the County Executive Committee. Mr. Leigh deliv ered an address to the Couven tion, announced that its purpose was the nomination of a Coun ty ticket for the coining cam paign', and called E. P. Aydlett to the Chair as Temporary Chairman. Upon taking the Chair Mr. Aydlett made a brief and forceful speech. Upon motion Mr. Aydlett was made permanent Chairman and S. S. Lamb, permanent Secre tary of the Convention. It was moved that candidates for the Legislature, Sheriff, Treasurer, Register of Deeds, Coroner and Surveyor, be nom inated in the order named. The motion was secjnded and car ried. Thereupon the following can didates were nominated, and elected by acclamation and without opposition: For Representative: T. P. Nash. For Sheriff: N. G. Grandy. For Treasurer: W. A. Foster. For Register of Deeds: J. C. Spence. For Coroner: Dr. I. Fearing. For Surveyor: J. C. Perry. The motion was made that the Convention thereby express its appreciation of the servi ces of T. B. Wilson Esq., as Chairman of the County Execu tive Committee in the late cam paign. The following resolution was then introduced: Resolved, that this Convention strongly and emphatically endorse the course of Hon. Jno. H. Small in the present Congress of the United States, and that the delegates to the approaching Congressional Convention cast the solid vote of the County for his renomina- tion by the Democratic party. The resolution was unanimous-, ly adopted. It was moved that the Cons vention heartily endorse the en ergetic and successful policy of the Hon. F. M. Simmons as Chairman of the State Execu tive Committe, and that this convention! urther recommend to the General Assembly his elec tion to the United States Senate to succeed fclarion Butler.
