From ALMAR FARM In Transylvania BY CAL CARPENTER (This is the second in a series of columns in which I state my objections to the proposed new gnu control laws.) Here is another thing I see wrong with the proposed gun permit - gun registration laws. These laws are entirely too subject to abuse. Yon might disagree about the Constitutional right to have guns. You might nitpick about the wording, as do the anti - gun people, and main* tain that the guarantee is ex tended only to organized militia. I do not agree with this, for I do not think there was much concern about guns for a mili tia when this was written into our law. Militia always have guns; what the founding fathers were guaranteeing was that the individual <h jntinersman’s long rifle would not .be taken away •from his as had been done in ■Europe. Had they only meant the militia they would prob ably not have made specific mention of ‘fthe right to bear ■arms.” It seems to me they would only have specified the right to a “well regulated” mili tia. That would have 'been suf ficient, and the writers of the Constitution and its Bill of Rights were not men given to superfious wording. But whatever an individual When you think of prescrip tions, think of VARNER’S, adv. YOUR GUARANTEE OF Service beyond the call of duty This symbol tells you we're professionals in property and liability insurance—independent insurance agents. Because we are independent, we're free to choose from among many fine competing companies, and rep resent your interests first. James C. Gaither Insurance Agency M S. Krond St. Phone 883 5470 might conclude as to the ex tent of the writers of this framework of our country’s laws, it must be conceded that the wording does not specify that only the militia has the right to bear arms. It there fore stands as intending that the individual shall have this right; as it has been interpret ed now for upwards of two hundred years. Now, in a time of sentimen tal reaction, in a time erf lib eral emotionalism when social theorists ride high and the rights of criminals, rioters, loot ers and so-called civil disobed ience adherents are judged by many to be placed paramount to those of patriots; when the courts in many people’s opinion have elevated legal technicali ties above justice — now is not the time to change this interpretation. Thus we must accept, as many acknowledged experts on Constitutional Law do, that the right to “keep and bear arms” in a Constitution ally • guaranteed freedom. With this in mind, lets think a bit about how the hard-line gun permit and registration laws can be abused; in deed, how they have been abus ed in those states unlucky enough to have them. The Police Chief or Sheriff must issue the permits. It is his perogative to deny them for any reason or for no rea son. If he doesn’t like the way you part your hair, he can suddenly decide there are too many guns in the city or county and deny you the per mit. No gun. If you’ve hid a parking tick et he can buy a gun permit on the grounds that you have a ••police record, which you have. There is little to stop him from conducting a personal campaign to reduce the number of guns in his territory, an aim which a lot of law enforcement of ficers support for reasons I’ll mention later. Proponents acknowledge this might happen bat say you always have recourse to the courts. Sure you do. You can take your case to the courts and af ter spending $10,000 on law yers and court expenses, after taking many days away from your job over a period of months and even years figh'ing the thing through the courts, you can probably beat -sur-h an arbitrary decision f you real s :?• s * KEEP YOUR RADIO DIAL SET AT 1240 WPN F Brevard. And you can get your gun per mit But who can afford the lo'-t time and this kind of money? Most of us would just find it easier to forget (he grn rod do wi bout It. And this is exactly what the anti - gun fanctics want us to do. Mrke no mistake about • hat They do not want to limit gun ownership as they cliim. For reasons ff their own, they want to take them away. Or, cnce given the permit to have, a gun, there is noth ing to keen the local law en forcement ch ef from harass ing you. You can be required to come in and bring your gun for repealed re - registrations. You o;n be required to appear intermit tantly and fill out new 5page forms which need infor mation and records you don’t have. You can be frustrated un til you just get tired and give up your gun. This is stiil doing exactly what the people who support the hard gun laws would like. They wart your guns, one way or anther. I do not contend that these abrses would happen here in Transylvania now. 1 know both the Sheriff and the Chief of Police, and I’m sore it would not during their ten ures. But I do not know the Sheriff and Chief of Police who may one day hold these positions. And I do know the officials in the many other cities and counties all over this country. This is sufficient cause to oppose laws that make such abuse easy. (To be continued in my next column) NOTICE In The Superior Court State of North Carolina,) County of Transylvania.)
