The plaintiff in thec restraining or der is the Dare Lumber Company which will soon locate a big mill here and which has established a tempora ry office in the city. j Whether or not the injunction will be made permanent will not be decid ed probably j before May. ! The tracts of land specified In the papers Mr. Spence, served are in dis pute and have been for sometime. Both the companies have Interests here and the greatest concern is felt by locals in the injunction proceed ing and the final result, 'as It will In fluence more or less the pperatlons of the interests in the future. SAYS STATE FISH LAWS i ARE REGULARLY VIOLATED Mr. T. K; Bruner. of the state board of lagriculture yesterday gave out information anl ventured, opinions concerning the fishing industry of the State of great importance to the peo ple of Iiq Albemarle section. He said: f There are certain things affecting tho fish industry in North Carolina that are in a condition which demand the most serious considera tion irom the people of the enti.e state. ) . 'j. Fish Below Size Are Cajaght. "While these conditions have effect with the fishermen most of all, it be ing a sourcej of revenue to them, the whole people: are affected however in I i j r .' food supply, and it this aspect of the case which is of -most Interest at present. ! Fishes far below the normal size are i . i- i . i taken, some finding a market at ridic- i i i i . ulous figures, and some being haufed out and used as fertilizers on the lands adjacent to the streams and sounds. ; Mullets Six Inches Long Sold. VI saw two bushel boxes of mullet at I New Bern, averaging four to six inches in length. Those boxes bring 50 cents each, 2Z cents going to the boatman for delivery at the market, and the other' 25 cents to the fisher man. i Had those mullets been allowed to remain in the water three to four years and then marketed during the months when those fish are in prime this is during August, September, Oc tober and November the contents of the box would have been worth fifty dollars instead of only fifty cents.' ' Should Protect Industry. ' 'This 'is an example of what, is be ing done. Tons and tons of such fish of this size are taken from tlie wa ters annually. Something should be done, and quickly, to stop this whole sale destruction of such valuable i'ooc i : ! i product. j ' Tt appears to me the fishermen would see it for themselves and think of the future and of their posterity, and allow all such fish to remain in the waters, but when questioned on this point reply. Tf my nets don't catch them y those next to me will.' Butter fish are also caught in the same way, to say nothing of the shad fry which are caught returning from the up streams to the salt 'water, and by the same nets. Wonder There Are Any Left. ' 'There being no markets . for these they are invariably hauled on land. And still the complaints are general in that region that there are no fish. Little wonder indeed, with this pro cess going on that there are an j- re maining.' ' (Continued on Page Three.) Mr. W. C. Glover, the local commis sion merchant, said this morning, and he is recognized authority, it Is use less for anyone to dispute the fact that there is a big reduction in acre age in the planting of Irish potatoes, and that present indications are the reduction will amount to all of fifty per cent. ' ' This statement he bases on reliable information furnished him by the far mers of the section, and still more up on the quantity of guano Delng sold. According to Mr. Glover there is scarcely a man, 4 'little' ' or 4 'big ' armer, who will plant the same num ber of barrels he did last year. The greatest reduction is among the little armers, some of whom will not plant any at all. Some of the larger plant ers will make reductions of as much as fifty barrels. The number of barrels planted, it is said, may be increased later, if the market conditions improve, but even that is considered improbable. Hufham, the venerable 'Nestor ' j of the Baptist denomina tion in North Carolina, arrived in Ral eigh yesterday from an extended southern trip to Florida. At the regular weekly prayer meet ing at the First Baptist church last night $220 was raised among the church members to help defray the expenses of moving the Baptist Chap el from its present location on North Road street to a site purchased for it by the First Baptist church in the factory district. The work of moving the structure is now going on under the supervis ion ' of Mr. Joseph Pritcnard, and it is one of the largest undertakings in this line attempted in the city. The plaps of the church concern ing the chapel have not as yet been completed, but when it is in its new location it is assured that regular services will be held there every Sun day. A Sunday school will be estab lished and in the afternoon and at night there will be preaching. At the present time the minister has not been decided upon. At a previous meeting the church appointed a committee to secure a minister for the chapel and for the station in the Seventh ward district, but no final reports have yet "been made. The establishment of the church In the factory section is one of the most important developments or the Bap tist church here in years, and the Sunday school and regular services will doubtless be productive to a great extent of the desired results. There will be a public game of bas ket ball at the Y. M. C. A. gs?in sium tonight. The two teams will be composed of the following well known players: Team No. 1 Harold Overman, Chas.
