An act to pave the sidewalk in front of the Court House in the Town of Hendersonville: That the Board of Commis sioners of the county of Hender son shall be authorized, empow ered and directed, to put down a cement sidewalk in front of the county court house on Main street in the Town of Hender sonville to correspond with the sidewalks already constructed in front of the property of private owners abutting on said street. An Act to Provide of the Work ing, Making and Maintaining the Public Roads and Bridges in Hen derson County. - Section 1. That chapter three hundred and twenty-eight of the public laws of 1907 is hereby re pealed. Sec. 2. That the general road law as published in the Revisal and as amended by the laws of 1907 shall be applicable to Hen derson County except as herein after modified. Sec 3. That the making; and repairing of public roads' and bridges in Henderson . County shall t be under the supervision, Qf one supervisor, to be known - as the Supervisor of Public Roads of Henderson County, here after called Supervisor, who shall re ceive an annuall salary of $1, . 250. 00 one-half of said salary to' be paid out of the public road fund and one-half out' of the bridge fund; that W. C. Jordan is hereby appointed as said, Sup ervisor for a term of four years from May 1, 1909. That at the general election in Nov. 1912 and bi-ennually thereafter, the Sup ervisor shall be elected by popu lar vote as other county officers are elected. Sec 5. It shall be the duty of said Supervisor as soon as possi ble and practicable to .make a complete survey and measure ment of all public roads in Hen derson County so that the bound ary lines between said roads and abutting property may be easily ascertained , when occasion re quires. He shall lay off said roads into sections of from three milles to five miles, the township. lines to be . marked on the plat and observed in laying off said sections so that no section shall be part in two townships. Each section of road shall be named and numoerea on saia piat or map which' shall be filed in the Supervisor's office and proper books shall be kept by . him so that the axact data can be had for the use of the public. All public roads and bridgesshall be made, worked and kept up under the supervision and direction , of the Supervisor. - The Supervisor shall, for the purpose oi letting roads out to contract, make and file in his office- detailed specifi cations as to each section, show ing how the road " shall be made and how worked and maintained. The Supervisor shall, in May of each year, after due notice to the public, let the. work on said said sections out on contract to the lowest responsible bidders. Provided, the Supervisor may, when in his judgment. the bids on any section or sections are too high, or when there are no bids, employ labor upon the best terms he can" secure to keep up" said section or sections. All contrac tors for sections of road under this act shall be paid one-thrid contract price every foruunonths. but never until the Supervisor shall have personally inspected said sections of road and approv ed the same, and for this pur pose the said Supervisor shall go over and inspect all public roads in the county each four months. No person shall contract to keep up two sections of road. The work upon " all bridges in the county shall be done by the contractor, when the public roads shall be let; by sections- to con tract; the lumber and hardware material to be .use?! in said brid ges shall be furnished by the Supervisor and delivered by him to the points where needed. Pro vided, that the bridges across French Broad River, Mills River, Green River, Broad River at Bat Cave, Mud Creek, Hooper's, Creek below Bud Maxwell's farm, Clear Creek below'W. B. Coston's farm, and Big Willow below Doc Patterson's farm, shall not be built or kept up by said contrac tors, but shall be built, repaired and maintained by the Supervis or. When any contractor fails to keep in proper repair.any sec tion of public road according to plans and specifications and re fuses to put same in proper con dition after notice from the Sup ervisor, the Supervisor may em ploy labor and have same put in proper repair and deduct the cost of said work from the contract price agreed to be paid the con tractor for keeping said section or sections of road in repair. Sec. 7. For the purposes of this act all the public roads leading into the town of Hendersonville shall be until they strike the streets in the town which are, or may hereafter be macadamized or paved, regarded as public roads. V r' be paid to the town -in lieu of letting said roads or streets in sections by contract as hereinbe fore provided to be used by the town under a prorata mileage basis in keeping' said roads .or streets .in repair. - Sec. 8. The uniform width of all roads in the county shall be sixteen feet except roads lead ing into Hendersonville' for a dis tance of five ' miles' from , said town which may in the discre tion o the Supervisor, as far as practicable, at all -places, be twenty-five feet. Sec. 12. The Supervisor shall keep in his office open to public inspection at all times complete books from which it can be read ily escertained what work is be ing done by him, what money is being paid out, to whom paid and for what purpose, and at the end of each fiscal year to-wit on the 30th day o June, or as soon .as possible thereafter, he shall pub lish a complete financial state ment of the public road and bridge funds, showing the amount on hand and the itemiz ed statement of the amounts paid out with the names of the parties to whom paid, keeping seperate the road and bridge funds. Sec. 15. The said Supervisor shall have control . of the. chain gang and shall have the right to organize or reorganize the pre sent chain gang. y Sec 16. That it shall be law ful for the State authorities to furnish the Henderson County chain gang with any number of prisoners committed to the State Prison that the said Supervisor may be able to use. Sec. 18, That for the purpose making, repairing and maintain ing the public roads in said county, the county commissioners shall annually, and at the time of levying other taxes," levy a public road tax of twenty cents on the one hundred ($100.00) dollars worth of all taxable prop erty within said county; and at the same time for the purpose of making, maintaining and repair ing public bridges in said county they shall, levy ten cents on the one hundred dollars worth of taxable property in said county. Provided that it shall be the duty of the said countv commissioners to increase such levy after year 1909, from year to year, to an amount sufficient to build, repair and maintain, the public roads and bridges in said county as may be recommended by the Supervisor up to but not in ex cess of thirty cents on the one hundred dollars worth of proper ty for public roads and fifteen cents on the one hundred dollars worth of property for "public bridges.
