The only point which the Post attorn pta to make against the brief Is that it asks for the throwing out of a whole county, instead the throwing out only of the two town whip In which the rascality and thievery were most pronounced. In fact, tho Post practically admits that these two township should be thrown outfor the frauds proven, but it objects to the throwing out of the whole county on account of these two rotten townshliw. If tho alitor of the Post had read the brief he whould have found a complete an swer to thin alleges I objection. We let tho following extract from the brief apeak for itself: 'It Is insisted by tho contestant that the vote from the entire coun ty of Craven, upon the fraud which has been disclosed by the evidence, should be excluded. It appears that, for the purpose of consummating the fraudulent schemes, 1,(100 Republi can voters were p'aced in two pre cincts, 1,100 in one, and 500 in tre other, and that in these two pre cincts registrars were imported who had no acquaintance with the vot ing population and who made un reasonable demands upon the popu lation for identification before they were permitted to register. It ap pears from the testimony that if there had been a fair registration as a matter of fact it was a physical impossibility for the voters who had been fraudulently and arbitrarily placed in Berne precinct to have voted during one election day. It appears from the evidence that the majority which was obtained by Mr. Thomas in this county is not made up of the increased vote cast for him, but that it was obtained by the suppression through these fraud ulent means of at least 1,600 Re publican votes, as appears from the vote cast in the said county at the election held in the preceding elec tion and nearly 1,800 when the comparison 4s made with the elec tion held in 1896. "It also appears that of this num ber so suppressed, at least 1,000 were suppressed in the precincts of Berne and Thurman. It is therefore in sisted that if nothing else appears and no other precinct of this county were attacked, that the conduct of the election in these two precincts, the methods employed and the votes suppressed have had such an effect upon the n suit throughout the en tire c unty that Justice can only be done and the confirmation of these frauds prevented by the rejection of the whole county. It can be seen that if methods such as these are permitted to be employed, and the only penalty which can be visited upon the guilty is the exclusion of the particular precinct in which the fraud was perpetrated, that fraud, Instead of imposing a penalty, be comes a means of conferring benefits. To Illustrate, if one political party which has the election machinery in its hands, but which is in a large minority In a county like the coun ty of Craven, desired to suppress the popular will and to convert an ad verse majority into a friendly one, ' it would have nothing to do but to place all the voters or a large major ity of them, as was done in the county of Craven, in a few voting precincts, induce fraud to be prac ticed openly, and, when the party that had suffered from the fraud sought redress, to contend that the remedy was to exclude the whole of those precincts and count simply the rest of the county. Such in justice cannot be tolerated by a body which enforces the law both in its letter and its spirit. If thl vote had been allowed a full, lair and free expression, the contestant would, it can be conn dently asserted, have received, a large majority in this county. Now if the editor of the Post has not the mental capacity to compr hend the above, it would le uselec for u to attempt to further enlighten him. It was clearly the purpose ol the Democratic election officials to openly commit such frauds in these two townships to make it certain that thev must be thrown out. So I they put over half of the Republican I vote of the county in these two precincts. A TRAVESTY ON JUSTICE, The proceedings of tho Schley Court of Inquiry up to this time have proven one thing conclusively, namely, that if it is in the power of the Navy Depaitinent to bring it about Admiral Schley will b made to suffer severely because he is not a favorite of the Crownin shield-Sampson clique wh'uh domi nates the administration oi our naval affairs. An 'exceedingly spirited picture of relentless vindictiveness Is afford ed by the antics of Lemly and Hanna, the two comedians to whom the Navy Department has entrusted the task of convincing the high- minded gentlemen who constitute the court of the enormity of the guilt of Admiral Schley in being present and doing his duty at the battle of Santiago, while the alleged commander-in-chief, with two of the bst ships of the fleet, was miles away. As a matter ot tact, what was meant to be a court of inquiry merely to nna out tne trutn in re gard to certain controverted matters has degenerated into a prosecution, which, viewed in the most favorable light, amounts really to a persecu tion. The efforts of Judge Advocate Lemly and his understudy, Hanna, seem so far to have been directed to securing testimony calculated to prove Injurious to Schley. Disre garding the prime and immediate function of such a court as is now sitting in Washington, their whole energies seem to be bent in an at tempt to bring to the dust the name and fame of the man who next to Dewey gained the foremost place among the naval heroes of the Spanish war. On the opening day of the investigation Lemly referred to mm as "tne accusea," ut was promptly corrected by the court. Since then, however, Hanna has likewise spoken of Schley as "the accused." It is plain that the court does not take this view of the mat ter, but, probably despairing of MOW I. AW AMI II UKMEIJY. It I safe to safe to say that if all the judge on the bench of North Carolina dealt w ith guilty criminal in the manner employed by Judge Robinson at the criminal term of the Wake county Superior court last week lawlessness and mob law would soon expire for want of op portunity to disport themselves. M ib law is begotten of contempt for judicial administration of justice. When court are lax in their effort and fall to throw around the com munity the safeguards to which every citizen is entitled in being protected from the criminally In clined, men are prone to take into their own hands the means of pun ish ment and redress which belong solely to the courts. Thus crime breeds upon crime, and men grow to look with composure and indiff erence upon violations of law, parti cularly when such violations are participated in by many. To be merciful is good; to be just is letter. The truest mercy is that which has the whole community for its obiect: the highest form of ju tice is that which looks to protect the inuocent. It seems that this has been exemplified by the able judge who presided over court last week. But however that may be, the firm nefc and fearlessness of Judge Robin son cannot tan to nave a most wholesome effect. There is no dan ger to our country more potent than disrespect for law and the means of enfor. ing law, ano the surest way to lessen that danger is for the courts to promptly, fearlessly, and rigor ously deal with those who refuse to obey the mandates of the law. The people of North Carolina have during the last few day l-n treat ed to a remarkable iqec'ele. The laws of North Carolina make it the duty of the Corporation Commimion to asseH all railroad property for taxation at it true value. Thi the Corporation CouimLion, 'it tecem, has failed to do, whereupon the Sheriff of Beaufort county has ap plied to the Court for a mandamus to direct the CoinmLvion to do what the law requires it to do. This mandamus was heard before Judge Robinson In Raleigh last w eek and we had the remarkable spectacle of the Corporation CommLidon and the Attorney General of the State appearing before the Judge and retdsting the effort to have them comply with the law. It seem that the Corporation Com mission admits that It has not taxed the property of the railroads at its true value, and further admits that the value of this property is in creasing from five to ten million dollars a year, yet the commission ers insist that under their under standing of the law the legislature of 1901 did not intend them to as sess this property nntil 1903. In short their position seems to be that while this property should be taxed, yet the Legislature has exempted the property until 1903 and directed them how to assess the property in that year. If the Legislature of 1901 could direct the Commission to exempt property for a certain length of time and then direct it how at a future time, after another Legisla ture has met and adjourned, to as sess property for taxation, then it Is in the power of the Legislature to exempt property for a hundred years and direct the Commission in1 the year 2003 how to assess this property. This would seem to be the essence of obsurdity. Judge Robinson, however, has denied the application for a man damus, though we are not yet in formed as to the grounds upon which he bases his action. What more could an anarchist's heart dndre than to have a red nhlrt campaign conducted by fraud, force and violence. WHITE MAN TURNED YELLOW. RESULTS OF ANARCHY AND MOB LAW COMPARED. The assassin of President McKin- ley was tried on Monday and Tues day of last week, and convicted. Judge Lewis, the able counsel assigned by the court to defend the assassin, devoted almost his entire speech to a discussion of the causes of anarchy and a comparison of the same with mob violence, lvnching and general lawlessness on the part of those who do not claim to be anarchists. The Judge boldly took the position that the peace of society and the perpetuity of the" govern ment were more endangered by the conduct of those who joined in mob law and other kinds of violence than by those who profess to believe in anarchistic doctrines and attempt to carry them out by the assassination of individuals. Indeed, he took the position that this government could never be endangered by the anarch ists, however dangerous and venal the class might be to individuals and office holders, to the extent that mob law rule and lawlessness may endanger it. If he had been fami liar with the situation in North Carolina he would, in describing mob rule, have referred to the law less gang of red shirts who terrorized different communities during the last campaign in this state. Judge Robinson, in his (fcarge to the grand jury last week, covered nearly the same points as those covered by Judge Lews. STREET INCIDENT. Hardly two witnesses have agreed on any one point, although all the officers testi fying have been, up to thfs time, witnesses for the department. One man testifies that the ships of Schleys squadron blockading Cienfuegos harbor were 25 miles out at night, and the next witness says that they were never more than five or six miles out and were nearer at night than during the day. Another officer says that on May 26th and 27th the sea was as smooth as glass and the ships could readily have coaled; while the subsequent witness unqualifiedly asserts that the weath er was rough and boisterous and "Yes, yes, so they do," replied the minister, and the two passed on.
