THE CHARLOTTE NEWS JUNE 25, 1921. SATURDAY JUDGE NOW HAS UP BANKS' CASE Brief in for Clearance Mat ; ter to be Filed Before Pronouncement. ; Judge E. T. Webb is expected to ren tier a; decision within the next two Weeks on the question of jurisdiction in the "par clearance" injunction proceed ings hearing cn this question having been concluded Friday afternoon after a session in the federal court room of three days. The court instructed attorneys for fccth sides of filf briefs citing the au thorities quoted in argments and also to file supplemental statements by some of the Richmond Federal Reserve iBank witnesses, elaborating on and ex plaining statistics given during testi Imony. .- Judge Webb will render his decision in time for the hearing of the injunc tion on its merits at early terms of federal or state courts. The- 250 "non-par" banks, plaintiffs in the injunction case, were seeking through their attorneys to hold the hearing in the state courts, while the Federal Reserve Bank sought to have At removed to federal court. It is this question that Judge Webb must decide "before the case is heard on its merits. INJUNCTION IN EFFECT An injunction to prohibit the Rich mond bank from evading the provisions ot the North Carolina par clearance 'act, permitting state banks to charge iexchauce on ceheks, is now in effect, having been obtained sometime ago be jfore Judge W. F. Harding, in the Meek ly lenburg superior court. The injunc tion was returnable before Judge J. Bis Ray. in the Union county court. Judge ijRay held that state courts have juris 'diction but the defendant bank appeal ed to Judge Webb for the transfer of r A Great Drama of Reborn Souls "LYING LIPS" BROADWAY Mon., Tues., Wed., Thurs. the case to federal court. If Judge Webb rules that the hearing should take place in federal court the injunction will become inoperative. State banks opposing the clearance of checks at par must then wait until the case has been settled, probably af ter reaching the United State supreme Court, before the privileges enjoyed un der the injunction can be returned or permanently denied. Should the fed eral judge return the case to the state courts for hearing the injunction will remain m effect. Thorugh evasion of the state par clearance act, the Richmond Federal Reserve bank has been virtually forc ing the exchange of checks at par, ac cording to complaint of attorneys for the "non-par" hanks. H. G. Connor, Jr., of Wilson, closed the argument of counsel in the hear ing Friday afternoon, and Judge Webb immediately announced that he would reserve his decision until considera tions could be given to the briefs and statements which are to be filed with him. "A Service Station That Serves" JUDGE BOYD TO SIGN THEDECREE Which Will Officially Give Southern Power Its Victory, i . Greensboro, June 25. Copy"of the tentative decree to be signed by Judge James E. Boyd denying the prayer of the North Carolina Public Service Cor poration against the Southern Power Company, which was presented to the court late Friday afternoon, was not acceptable to Judge Boyd and he direct ed the attorneys to recast it. making minor alterations, and present .it to him Tuesday when he will put his signa ture , to the order which will officially give the Southern Power the victory it has been struggling for. After the reading of the tentative decree, a brief debate ensued as to the amount the service company must pay to the power company for the power furnished from January 1, 1921, to the present time, and for current to be sup plied for the next six , months. Judge Boyd finally intimated that he wouia fix the price on the power furnished from January 1, 1921, to the present date, at six mills per kilowatt hour, I and require the service company to fur j nish a bond for the amount due; and a rate of 1.1 cents per kilowatt hour for power to be furnished in the fu ture. The new decree probablv will con tain a stipulation granting the plain- liii a. ifiuiiu ur uuaignig it cui ctuuiLiun ai amount, depending upon the rates fixed by the corporation commission. During the rate argument. A. L. Brooks, leading counsel for the Public Service company, thought that the rates shouldn't be discriminatory, de claring that for that reason the case is now in the courts. He called atten tion to the evidence which stated that a cotton mill in Spray is now getting power at eight mills per kilowatt hour, and a number of municipalities tt 1.1 per kilowatt. "That's the reason," said he, 'the cotton mill men went to Raloigh to get the corporation commission to fix the rates, they want to get tway from discrimination." MAY PURCHASE CURRENT. The tentative decree Turther declared that the public service company is en titled to require the power company to sell and deliver to it at the terminal or delivery point at which the defend ant has heretofore sld and delivered current to the service company, elec tricity for use by the service company as a motive in operating and propel ling the street railway system operat ed by the service company in the citifs of Greensboro anj TIi?h Point, provid ed fthat the service company make ap plication to the defendant company for such current and rjceive and pay for it upon the same terms an I conditions and at the same rates and under like rules and regulations atf the defend ant company sells and delivers current to other customers for similar Moes and purposes under similar conditions; pro vided, however, that the service com pany pay the defendant for current which has heretofore been sold since January 1, 1921. ifma gtf tfim m&$$ Tr-: IfAyJKMf APM D -KMC Ibook I Should you reach the end of your rope would you have to let go? The shirt of silk , adorned his manly breast and his three dollar tie pro claimed his artistic taste and his utter disregard of mere matters of money or credit. She said "just speak to Papa" and to papa he strode with those same socks of silk, that same shirt th at spurned the cotton field, and with that rainbow tie. - AND PAPA SAID v "How many shares do you carry with Keesler and the Mutual?" None. I don't like to bother with little things like that. That's for working people. "Is your suit paid for, and what did it cost." It cost $75.00 and I'm paying for it monthly, that is I'm going to start on it next month. "How about your socks and handsome tie and lovely shirt?" Oh, I have an account and don't have to pay cash. "Do you belong to the clubs? Oh, yes, I'm a member of all .the best clubs and entertain in approved style. "How about the church, and do you help your parents in their strug gles?" I'm a member, , but don't go in for sissy stuff' very strong. Don't have the time. As for the old folks, they don't bother me, and' I have my own affairs to look after. ' "How much have you saved during the last 5 years?" Well, I haven't saved anything yet, but I'm going to start when. I'm married. PAPA TOOK HIM SOFTLY to the door and said "I've worked hard for what I have, and I'm willing to support Susan as long as she lives, but if she even wanted to marry a feller of your stripe I'd be tempted to disown her. You're just a simple, ordinary fool, and hunting for a support. Go learn something of real life anl some day you may" be able to marry a self-respecting girl.
