in the injunction case, were seeking

If Judge Webb rules that the hearing
should take place in federal court the
injunction will become inoperative.
State banks opposing the clearance of
checks at par must then wait until
the case has been settled, probably af
ter reaching the United State supreme
Court, before the privileges enjoyed un
der the injunction can be returned or
permanently denied. Should the fed
eral judge return the case to the state
courts for hearing the injunction will
remain m effect.
Thorugh evasion of the state par
clearance act, the Richmond Federal
Reserve bank has been virtually forc
ing the exchange of checks at par, ac
cording to complaint of attorneys for
the "non-par" hanks.
H. G. Connor, Jr., of Wilson, closed
the argument of counsel in the hear
ing Friday afternoon, and Judge Webb
immediately announced that he would
reserve his decision until considera
tions could be given to the briefs and
statements which are to be filed with
him.
M'CLAREN WINS TWO
CASES BEFORE COURT
. The McClaren Tire Sales company
was the winner in two cases settled

the tire company was awarded dumages
claimed to be due by the defendant
companies not carrying out a contract
for purchasing certain supplies from the
plaintiff company. The amount of dam
age from the Parkton Motor company
was $267 and the amount in the Ashe
ville case was $2,002.65.
Israel Schwartz, defendant, was a
winner in the suit brought against him
F-iday in court by J. E. Crayton, in
which the plaintiff sought damages be
cause a truck driven by the defendant's
minor son ran into a car belonging
to the plaintiff.
A case that has been on the calendar
for a long while was settled by agree
nt VrMav afternoon and signed by
Judge McElroy was that of A ithony
(Ragsdale against the Virginia-Carolina
Chemical company, me piamuu "is
awarded $400 by the company for per
sonal injuries sustained by the plaintiff.

SIGN THEDECREE
Which Will Officially Give
Southern Power Its
Victory, i .
Greensboro, June 25. Copy"of the
tentative decree to be signed by Judge
James E. Boyd denying the prayer of
the North Carolina Public Service Cor
poration against the Southern Power
Company, which was presented to the
court late Friday afternoon, was not
acceptable to Judge Boyd and he direct
ed the attorneys to recast it. making
minor alterations, and present .it to
him Tuesday when he will put his signa
ture , to the order which will officially
give the Southern Power the victory
it has been struggling for.
After the reading of the tentative
decree, a brief debate ensued as to the
amount the service company must pay
to the power company for the power
furnished from January 1, 1921, to the
present time, and for current to be sup
plied for the next six , months. Judge
Boyd finally intimated that he wouia
fix the price on the power furnished
from January 1, 1921, to the present
date, at six mills per kilowatt hour, I
and require the service company to fur j
nish a bond for the amount due; and
a rate of 1.1 cents per kilowatt hour
for power to be furnished in the fu
ture. The new decree probablv will con
tain a stipulation granting the plain-

ai amount, depending upon the rates
fixed by the corporation commission.
During the rate argument. A. L.
Brooks, leading counsel for the Public
Service company, thought that the
rates shouldn't be discriminatory, de
claring that for that reason the case
is now in the courts. He called atten
tion to the evidence which stated that
a cotton mill in Spray is now getting
power at eight mills per kilowatt hour,
and a number of municipalities tt 1.1
per kilowatt.
"That's the reason," said he, 'the
cotton mill men went to Raloigh to
get the corporation commission to fix
the rates, they want to get tway from
discrimination."

to sell and deliver to it at the terminal
or delivery point at which the defend
ant has heretofore sld and delivered
current to the service company, elec
tricity for use by the service company
as a motive in operating and propel
ling the street railway system operat

plication to the defendant company for
such current and rjceive and pay for
it upon the same terms an I conditions
and at the same rates and under like

pany pay the defendant for current
which has heretofore been sold since
January 1, 1921.
