It is no longer against the law for hotels and restaurants in Charlotte to ,st;ive quail on toasi or quail in any . other form. The last session of .the General Assembly passed a Jaw amending the public laws of the 1919 session when it was decreed that if any eating houso of any sort in Mecklenburg county, hotel, restaurant or any other place of serving meals to the public, should be found with quail in their possession it would be regarded as prima facie evidence of violation of the game laws of the county and the violators would be subject to punishment. That clause was stricken out of the laws at the last session in a bill introduced by Representative W. R. Matthews, concurred in by the other members of the county delegation, by which "hotels, restaurants and other eating houses are stricken from the list as to which possession of game is prima facie evidence of guilt." Mr. Matthews, the author of the amendment, savs that it h.nri reported to him that me law was being violated in Charlotte by some of these public eating place whereas others wnp wanted to be law-abiding were being hurt by unfair competition from ir.oae wno were not so scrupulous. He was importuned, he says, to in " troduce the amendment so that all restaurants, hotels and cafes would be put on an equal basis in that they will be allowed the privilege of serving quail. The law against the sale of birds to public eating places and . on the public, market has not been affected by this amendment, but it is pointed out that the restaurants and hotels will have no trouble in getting all the birds they want. They are offered here from neighboring counties and are easily procured. Of course, if the venders of these, birds should be caught, they could be prosecuted, but there is no obligation resting upon the purchasers to inform the officers of the sale of birds or to aid in the running down of those violating th law as to the sale of quail. This is taken to nean that during the present open season any person who wishes may call for a quail-on-toast at the eating places of Charlotte without having to go through devious and clandestine mpthnrfn appetizing menu. If the restaurants and hotels can find them to serve, there is no violation in serving them.' Mr. Matthews points out that the reason that this amendment has no teen disclosed up to this time is that the private laws of the State, as passed by the last General Assemblv nave not been published. Trouble with the printeries of Raleigh have held up the delivery of the voluminous laws Passed as applying to local communi ties, the public laws only, having been given to the presses.
