Five white convicts captured here by the sheriff and a posse of citizens after their es cape Sunday night from a chaingang camp near .Cherokee. N. C. left here yesterday in custody of the sheriff for Murphy. N. C, to be returned to camp. The men, who said they tunnelled their way out, give their names as Bonnie Ransom. 18, Concord; Bob Al len. 26, Durham: Jimmie Madray. 3l Wilson; Clifton Jarvis, 22, Winston-Salem and Bascomb Robinson, 24. Robin son declined to say where he was from. Asheville. Dec. 15. Five of the six convicts which escaped front the State stockade near Murphy Sunday night, were captured yesterday near Ellijay, Ga., according to reports reaching here last night. Names of those captured could not be ascertained but it was j reported they were still wearing their i stripes when apprehended. They will be returned to the camp near Murphy. FOR SALE! Requisi tion papers have been signed by Gov ernor Morrison ox North Carolina for Peake's return to this city and these have been recognized by Governor Taylor, of Tennessee, but the habeas corpus proceedings will prevent the de fendant's removal until the Knoxville authorities pass ttpon the case. Peake s lawyers claim that they have ten or more witnesses who will testify that he was in Knoxville at the time of Ashburn's murder in this city, while officers here have witnesses who state the defendant was seen in Winston-Salem during the day preceding the murder. The prose cution continued today its presentation of evidence surrounding the murder of Mrs. Margaret Eastlake at her Colonial Beach home on September 30, for which Roger D. Eastlake, her husband charg ed with the killing jointly with Miss Sarah Gnox, a Baltimore trained nurse, is on trial here in the AVestmoreland county circuit court. The little courtroom again was crowd ed Xo capacity today as the State pre pared to produce further testimony from Mrs. Blanch E. Kennedy, a neighbor of the Eastlakes at Colonial Beach, who yesterday gave testimony intended to refute the defendant's claim that he had left home shortly before his wife was murdered. Preceding Mr. Kenedy on the stand yesterday, Dr. O. V. Caruthers and his son, W. V. Caruthers. both of Colonial Beach, descrived the scene at the East lake home when they went there on the morning of the murder. Dr. Caruthers testified that he found Mrs. Eastlake's body in the dining room of her home and that an examination convinced hkn that a knife as well as a sharp edged hatchet had been used in inflicting the twenty-nine wounds found on Mrs. Easr 'ake's bodjr.
