REFUSES TO LEAVE JAIL FOR STATE'S PRISON AND HAS TO BE MOVED BY FORCE HIS OWN FATHER HAS A BAD OPINION OF HIM. (Raleigh Post.) Elizabeth City. N. C. June 15 Sheriff T. F. Winslow of Perquimans county, together with his deputy, Mr. Isaac White, left on the evening train to take Jim Wilcox to the penitentiary, where he goes to serve a thirty-year sentence for the murder of Nellie Cron sey. He was driven to the depot in a closed carriage, accompanied by Sheriffs Reid and Winslow and Deputy White. Quite a throng awaited his arrival, eager to take the last look at the reputed slayer of poor Nellie Crop sey. Wilcox stubbornly refused to leave the jail, saying that he was not going to the penitentiary. He had to be car ried by force to the conveyance, not withstanding the entreaties of his fa ther and friends. He declined to put on decent clothes. He went off with out coat or top shirt. He put an old ragged shoes, torn pants and a worn and soiled hat.. He was insolent and abusive to the officers. . He fired three shots in his cell today from a pistol he had secret ed about his person, and then gave it to the jailer. "I had that gun in the court room on my person during both my trials.' said he. "I don't expect to work in the penitentiary. I shall not be there long. I shall soon be back here. People will know when I get back." He took a big drink of whiskey be fore leaving the jail. A bottle was given to him at the depot, but an offi cer took it from him. He said Sheriff Reid had been kind to him. He had nothing for the press, but would make a statement to reporters at Weldon. j He was boisterous and swore at the ; depot. He bade a, few friends goodbye, j His father never saw him after leav- j ing the jail. After Jim acted so out rageously his father remarked: "He, has got more hell in him to the square inch than anv man I ever saw." (Elizabeth City Tar Heel.) Prosecuting Attorney Ward yester day received a telegram from the at torney general of State stating that the Supreme Court had cofirmed the de cision of the lower court in the Wil cox case. The case of the commonwealth against Wilcox for the murder of Miss Nellie Cropsey, November, 1901, is too well known and has been too frequent ly published to admit of any great comment. It is alleged by the prose cution that Wilcox threw Miss Cropsey into the Pasquotank River, causing her to drown, or that he first struck her and then threw her into the river, marks on her head showing concussion from some cause. The defendant has had two trials and twice the case has been before the Supreme Court, the last time resulting in a confirmation of the case as it was decided by the Perquimons county court. The first trial took place in this city; the second trial was held at Hertford, the county seat of Perquimmans. Judge Jones presided in the former case and Judge Count M in the latter trial. When a p' :y consisting of the sher iff and Chic. Dawson with several cit izens were admitted to the prisoners cell to break the news to him, they found him quietly reading a paper. The sheriff quietly announced the de cision of the court to the imprisoned man, and requested permission to search the cell. This act was done to prevent any attempt at suicide. It was evidently unnecessary, however, for the young man was quite cool and seemed not to pay any great attention to the news, which means, in the words of the jury's verdict, thirty years in the penitentiary. The only thing found in the cell was a ra: or which the sheriff had loaned Wilr jx. This was removed. On leav ing che cell Wilcox jokingly called to the sheriff, requesting him to come' bac": and make up his bed, which had befii tumbled up in the search. Chief De vson remarked, "You will have ph nty of work to do when you get to tfc 3 penitentiary, won't you Jim?" The ai swer was, not have any work to do there." It is not generally known that Sher ;f Reed will not convey Wilcox to the penitentiary at Raleigh. He will be es corted hither by Sheriff Winslow, of Perquimmans County, where the last verdict was rendered. Wilcox himself, is alleged to have expressed a desire to have Mr. Reed take him to Raleigh. During his long confinement in the local jail, Wilcox has had every possi ble courtesy shown him by the sher iff and the jailor. He seems. to appre ciate this kindness,, and is not alto gether the grum, rough prisoner which report would make him. Naturally he feels the disgrace to which he is be ing subjected and is affected thereby. It is said by many, that in light of the fact that Wilcox was convicted on circi mstantial evidence a petition will be brought to the Governor asking for his pardon, after he has served a part of his sentence. There are few who really think the young man will ever serve the full sentence. In the first place the penitentiary rules provide for a reduction of time for good behavior and faithful work. This will reduce the term four or five years, if the young man makes a good record. In addition to this a good record is an al most sure means to bring him before the executive eye in the matter of par don. Of course the excitement of the present day will have subsided after the lapse of five or ten years, and it is predicted by many that Jim Wilcox will be a free man many years before the year 1933.
