'Alley vs. the Charlotte Pipe Foundry Company reported late yesterday afternoon. awarding the plaintiff $ 6,000 damage for injuries he received while in the em ploy of the company. The plaintiff asked for $10,000. The defendant com pany will appeal from the decision of the :rr. r Mr. I?'. W. Alley, the plaintiff, was Injured by the explosion of a mould cm the 2Sth of November, 1910, and brought action for damages In Decem ber, 1910. The case came to trial at the June term of civil court, resulting In a mistrial, eleven jurors voting in faovr of awarding the plaintiff and one opposing the idea of awarding any- damages at all. The case has occupied four days of the court's time this week and has been one of the hardest fought cases ever before the Mecklenburg civil court. Eighty-five witnesses were ex amined, many of them experts in the moulding profession. The case also required the presence of a great deal of machinery and moulding apparatus. -The amount of damage consisdered by the jurors was from $6,000 to $10,000. The attorneys for the plaintiff were Col. T. L. Kirkpatrick and ex-Judge F. I. Osborne; for the defendants Messrs. Davis & Davis, of Wilming ton, and Burwell & Cansler, of Charlotte. Mi. Sykes Celebrates His 75th. Birthday About a hundred relatives and friends and veterans met yesterday at the home of Mr. John B. Sykes at No. 304 North Allen street to cele brate the latter's 75th birthday. Mr. and Mrs. Sykes were married Au gust 21, 1S66, and to them were bora ten children, five boys and five girls. There are 28 grandchildren living. It was also the birthday of Mrs. Fan nie B. Sykes, a daughter-in-law, who is 32 years old; and also the birthday of Miss Cornelia Cochrane, who is 14 years, and who is the grand daughter of Mr. C. B. Sykes, a broth er of Mr. John B. Sykes. Both of these were present yesterday. A bounteous dinner was served at noon and a program carried out. The afternoon was spent in singing, talk ing and recalling many happy days. Mr. C. B. Sykes, who fought through the civil war with his brother, Mr. Jchn B. Syke3, has always lived and the relationship between them has always been beautiful. The following program was carried out: . Mr. and Mrs. Albert Aycock, of Wedgeneld, S. C, suffered a serious loss by fire last Wednesday night. Their barn was burned together with 35 head of horses. . The origin of the fire is not known. The barn was a sufficiently large "building, to accommodate not only the -farming Implements, but the number of horses as above 6tated. Gu&sie Frank Thomas, a nine-year-old boy, while jumping on and off a slow-moving freight train yesterday afternoon near where Park avenue crosses the Southern railway, fell be neath the wheels and suffered such in jury as necessitated amputation of the left leg just below the knee. The distresing accident occurred near the home of the lad's grandmother, Mis. Peter Osborne, with whom he lives. Physicians were summoned at once and the boy taken to St. Peter's hospi tal. The amputation of the foot follow ed immediately and was very successful. Tornado Killed Child. By Associated Press. Winfield, La., Jan. 20. A tornado swept over this section yesterday, wrecked the dwelling of Albert Walles, seven miles north of here and killed his little daughter.
