Moore to hear the con- ddemnation proceedings brought by the city board of water commission ers against Mr. W. S. Alexander and The Industrial Development Cocpany to secure the right of way for the! pipe line to the Catawba river, ren dered their decision yesterday after noon, awarding Mr. Alexander and the develoDment company no dam ages The jury consisteLpf Messrs. E. L. Keesler, J. A. Durham, George P. Wadsworth and ' H. G. Ashcraf t. The property of Mr. Alexander and the Industrial Development Company ad join each other, the conditions being exactly the same in both cases, and therefore the same jury sat in both cases. The opinion of the jury was that no damage was done to the prop erties by running the pipe line through them and they rendered their verdict accordingly. Mr. R. C. Dellinger, against whom the water board also brougnt con demnation action, was awarded 0125 damages by the jury which heard that case a few days ago. The jury in that "case held that the property was damaged slightly and that the plaintiff should have $125 therefor. Todd Case Next . The only case now remaining is the Todd case and the clerk of the court has appointed the following gentle men a jury of apprisal to estimate the damage, if any, done Mr. Todd's property by the presence of the pipe line. Mrs. Baxter J. Hunter, of De rita; Henry M. Armstrong, of Route 7, Charlotte; Rev. D. A. Austin, Char lotte i W. F. Baker, Route 2, Char lotte; Charles M. Carson, Charlotte. This jury will examine the property and hear the arguments of the at torneys in about ten days. The water board was" at first con fronted with several suits of the above type in its work . of extending the water system to the river. How ever, they did not all have, to be tak en before the clerk of the court for arbitration, but were adjudicated be fore the proceedings were instituted. Comparatively few of the property owners between thee ity and the riv er objected to the pipe line passing through their property and - some of them welcomed it coming, one large andholder having said that rather than ask damages for the presence of the pipe line he would estimate his property benefitted 5,000 by be ing on the pipe line. . !
