So much interest was munir,!! long before the hour for Court to con vne the room was filled' aud - when Judge Shepherd made hi nnrir. anceat half past nine o'clock, the piace -was packed and there was hardly standing room left: f oIicitor Strayhorn and the coun sel for the prosecution, Judge KulHu. came in on time but the prisonc r and his counsel, Moirs Boyd. Morehead and Barrenger did not ma!.e their appeixranexj untii after ten o'clock. After all had -arrived tin court was lcr and ti ie clerk began calling oyer the regular jury but all of these were objected to by thecoun sel, and noi nutil nearly all of the one hundred summoned the sheriff were examined was the jury chosen and impannellud : ' " : The solicitor then read the bill of lndictment.to the Jury, the prisoner standing during the time. He ap peared nervous and uneasy and was seen to flinch whenever the word murder' was "pronounced by the solicitor. ' - After some little delay the witness es were called and sworn,.as follows: Messrs Hugh B. Peters. Peter Sikes. Austin Hall.-John Moore," Geo.. Stan field jand Dr. C. M. Glenn. Willis Morehead and Jas. Reece. All the -witnesses are colored ement ti, first and last named."' . Mr. Peters took the stand and tes tified as follows: At about ii o'clock on the 7th of last Marcfr my draymen were hauling turf for the National- court house grounds. Chas. Blackman drove one of my drays. I was in his wagon on this day, as Ife was driving out on the Asheboro road to a place where the men were cutting turf. When we reached Hairston's store, which is on the left hand side of the road, Charles stopped his : wogm in front- of the store; and I got out and got into an other; of my diays which was going back to town, j As we druve off. I looked back and saw Charles stand--ing in his wagon in front of the store. After; we had gone on about -forty or fifty yards I heard a pistol shoti and turning around saw smoke in the door of the store, and saw Charles stagger back in his wagon. Wc then turned round and went back to the store and found that Charles had been shot in the left side, lie told me he was going to die; I instructed a jinan to drive; at once to Dr. Chas. Glenn's office, which he did; I came on in - a few minutes, i - . On cross examination, by Mr. More head. Mr. Peters stated that he saw a gun in Chas. Blackman's wagon. It was an old niusket and had no cap on it.-Aftcr; further- cross examination Mr Pttors left the stand. -' The .i-rext witness fof the niosecu- Llion was a colored man, by the name of Sik.s, . who lives in Warncrsville. We saw Charlie talking, to Hairston and turn his wagon a round and j stop right, in front uf ihe store. - I saw Hairston go around 4 to to the-back of the wagon and lake out a muskeU He put it- back though, and thenweat intolhis store. . Belorc-he went in, 1 heard he and Charlie talking about a quarter wjiich Charliervas asking him for. d& said 'You ought to pay me, for the boss man has charged it 'to, me, and I don't think 1 ought to loose it.". Hall then went into the store - to light his pipe. Sep. 371887 shot at Charlie, who immediately ex claimed. "Man, why did you shoot me. when I was doing nothing to you." Hairston.said "Didn't I fool old Char lie ; he thought he was thot." and he went into the etore laugfiing. Char lie then said -I am done with you and everybody else I reckon," and then asked me to drive him up to Dr. G'enn s office. While on the way there he said to me. "I am going to die" and he seemed to b uffertng very much." At this point the .court took a. re cess for dinner, and when it, convened at half past two. Mri Morehead cross examined Peter Sikcs. but nothing else ot importance was disclosed. Dr. C. M. Glenn took the stand and testified as follows; At eleven -o'clock on Monday the seventh of last March, I was compg to my office. yand no ticed that a crowd had collected around the door. As I came up some one told me thatCharle Blackman had been shot, and they wanted me to ex amined the wound. I went to him and found him in much pain, but saw I could do nothing for him there, and so I told the, driver of the wagon on which he lay to carry him home and I 'would come doivn and examine turn. As they carried him off.Mr. Peters and myself got into my buggy and went down. We jound Charlie in much pain and orrcxamination I found that a bullet had entered his right side be tween the sixth and seventh ribs, and on probing found that it had glanced up toward the lungs. I did all I could for him. I went back agaiu on the next morning and found him worse He asked me if l thought he would die. and 1 t !n him that 1 hoped not; but he said he knew Ithat he would die. and asked; why some, one "Mid not come to take his diing testimony and asked me if I would -not lake it. He then told me all about it. - After some discussion on the part of the counsel as to the competency of the dying testimony,. as given to Dr. Glenn, the witness was examined by the defence and dismissed. .The Solicitor then said that the state would not introduce any more" evidence just then, but would wait til! later - ok. ..... Mr. Boyd if the defence then-called his witnesses and after thny were sworn, one or them, a deaf colored man, Andrew Walker by name, stated that he was at Hairston's store when Blackman drove up and that Peter Sikes. who h?d testified for.the state, was not there. Witness said that Charles Biackman drew a gun-on Hairstonand: deniandc.i a quarter: Hairston said he did not owe hinv any money and went back in to the store and soon ami back with a pistol and in a laughing way said something to Charlie who then said. "I couW have killed you a long time ago" and as he said this the pistol in Hairston s band went off, and Charlie said, "If you are going to do that way I am going off which'he did. Witness stated that Allen said ''rtird not know the pistol was loaded, and asked Char lie if tie Was hurt. Ch.irhe shrink hi h;ad and drove on towards town. Witness stated that no one was there except himself and a man named Jim Howeil and the two men.- - Col. Boyd then called Maggie Haitston. the wife of the accused, who stated that Sikes hid told her on the' street the evening after the shooting that he taw Charles Blackman draw a gun on Hairston. She also staled that she ha.r gone to see Blackman afici he w.i.. shot ami i.e had told her that hed d nt think H.msteu did the sho ti.i: i- t ii ion dy. Mr. Ruffin asked that the court adjourn till U-inorrow. as he wished to collect more evidence. D., was ten dered and has accepted the position of Demonstrator of Anatomy in the med ical department of the University of Virginia Salisbury Watchman. Mr, D. Brir.gle and wife was up at this term of court for keeping a disorderly houss and plead guilty. Judgement was suspended on condi tion that. Dave would resign his oflice Magistrate and move from the lo cacality in which he was living. Salisbury Watchman. Asheboro Courier: Two barns in Pleasant Grove township, containing a quantity of feed, etc. have been burned by lightning within the past three weeks, one belonging to James Patterson, the other to Alfred Kivilt. Murphy Burn's of Columbia township lost his barn in the same manner last night. Married. last night, at 6.30 .clock, at the Institute for. the Deaf and Dumb and Blind. Mr Jonas M. And it seem a if the interests of these citie shape the railroad policy of the Stat rovermcnt of North Carolina. We doubt if those in authority had the power they would sell the State's interest in the A. & N. C. R. to the C. F. & Y. V. at what it cost the State.
