WILL HOLD OFFICE. County Offlcer in Arkansas Said to be Armed to Resist a De cree Ousting Them from Their Positions. Memphis, July 24. Dispatches re ceived here today told of a serious state of affaids in Osceola, Ark., where it was claimed Sheriff Rowen and Circuit Clerk Driver refused to vacate their offices, although having been removed by the Or vernor. It was said that many persons were armed and an out break was regarded as imminent. A correspondent was sent to Osceola this afternoon ov.d at 8 oclock tonight a telegram was received from him, stat ing that the stories had been exagger ated and that the town was quiet.,, "0 A tow days 'agrrtlo vernor Davis re J voked the commissions of Sheriff Saiu Bowen and . Cirucit Clerk Driver and issued commissions to John A. Lowell and J. W. Rhodes, respectively. At the election last September Rhodes ran for clerk and Lowell for sheriff on what was called the independent ticket. The returns showed that Driver and Bo wen were elected and they have held the two oSlces since, A contest was insti tuted in the courts and the county court declared Lowell and Rhodes elected. The Circuit Court held to the contray and on appeal the Supreme Court of Arkansas on July 13 sustain ed the r i uuty mourt and remanded the cases. G vernor Davis thereupon re voked the commissioifs of the incum bents. The report reaching here that the Driver and Bowen factions hold possession of the court house and refuse to vacate, while Lowell an 1 Rhodes are supported by a strong armed following and a clash is expect ed at any time. Driver and Bowen, it is said, dispute the authority of the Gov ernor to revoke their commissions. Feeling runs high. Around the World in Sixty Days Chicago Record-Herald. Charles C. "Around the World in Eighty Days" was written less than thirty year? ago, and that it struck contem porary readers with all the charm of wild romance, we must feel more than ever how marvelous is this era of pro gress in which we live. PIneas Fogg fascinated because he was so unreal, so superhuman. Admiring younth fell d6wn and worshipped before his nerve and nonchalance, which even they knew was too good to be true. Leavenworth, Kan. , July24. Michael Kelly, an irsane man totdjiy at the of fice of the Robert Garrett Lumber Company, in the businesVstrict, shot six people, killing one, prebaly fatally wounding another and n?ore or less se riously wounding four jpliers. He was himself finally killed bj? officers who tried to overpower hiniThe victims. John R. Garret, aged 4gjunior mem ber of the firm of the.Kobert Garrett Lumber Company, die-at hospital; Michael Kelly, aged 5aied after be ing taken to the police station. Injured: Dr. Charles McGee, aged 30, shot in back and probably fataly wounded: Police Sergeant Mm Jbdge, shot in neck; wound serious; iijchael McDon ald, detective, shot in slight; Jos. Falthger, policeman, tfbt in hand, wound slight. . Kelly had lived in Leavenworth for years and at differentltimes had en gaged in minor businesSpBnterprises.F.e was arrested and adjudged insane,Gar rett, and four others testifying against him. After a year in the Topeka asylum, Kelly was released. He had been acting queerly agstfn and had de clared that he would kill the five men 4- who sent him to the asylum. For two weeks he has been practicing shooting with a revolver daily at the Fort Leav enworth range. Last night he drank heavily. Soon after 12 o'clock today he ap peared at Garrett's office and without warning shot Garrett as he sat at his desk. Garrett fell to the floor and Kelly deliberately firedj four more shots into the prostrate form. Leaving his victim for dead, Kelly ran to the rear of the company's lumber yard and be gan reloading his revjplver. Presently hejreturnedjtp the officj to find Dr, Mc- 'vjee, wno naa ueen tKiiaetea oy- xne shooting, bending over Garrett. Level ling his revolver Kelly took aim at the physician and fired. The bullet struck McGee in the spine, an 1 I e -oppied over near where Garret lay. Then followed an exciting street fight between the madman and officers who came upon the secene. Kelly, flourish ing his revolver, dashed through the lumber yard. He met Ike Healer, a la borer.and shot him in the hand. A few yards further on the encountered Ser geant Dodge. The two exchanged shots as they ran. Ore bullet from Kelly's revolver struck Dodge In the neck, but not before the officer had shot him in the shoulder. Kelly kept running and was soon confronted by Detective A'"c Donald and Officer Flather. McDon ald dropped Kelly with a bullet in the neck. Dodge. raised his revolver, but it failed to work and catching up with the murderer, he crushed his skull with the weapon. Kelly was carried to the station in an unconscious condition. He died soon after his arrival tpere. Garret did not regain consciousness and died an hour after being taken to the hospital. Dr. McGee is still suffer ing seriously and it is believed he can not recover. Dodge's wound is not con sidered fatal, while the wounds of the others are slight A Little Fable Baltimore American. He based his Argument upon the Fact that the College Man could not Earn any more than the Moneyed Man would pay him. ' Moral: Let us have a Cash Register Course in Our Colleges, c '. A COURT FOR SCHLEY INQUIRY. MR. LONG WILL NAME ITS MEMBERS Admiral Schley Calls the Attention of the Secretary of the Navy to the Statements Coutained in Maclay's History Regard ing His Action in the Fight Off the Cu ban Coast aud Auks for an Investigation. Washington, July 24. Secretary Long this morning received a letter from Rear Admiral Schley calling at tention to the criticisms against him which are contained in Maclay's His tory of the Navy and the innuendoes which have appeared in the press for several days, and stating that, in his opinion, the time had now come to tako such action as would bring the entire matter under the clear and calm re view of his brothers in arms. He asked that the Department take such action as was deemed best to accomplish this purpose. He also requested that what ever action be taken should occur in Washington, where his papers and data are stored. The Secretary imme diately decided to comply with Admiral Schley's request and dictated a letter to the rear admiral, saying that under the circumstances he heartily approved of his action and that the Department would proceed at once in accordance with his request. Admiral Schley's let ter is as follows: "Great Neck, Long Island, N. Y., July L'2, 1D01. "Sir: Within the past few days a se ries of press comments have been sent to me Irom various parts of the coun try of a book entited 'The History of the Navy,' written by one Edgar Stan ton Maclay. "From these reviews it appears that this edition is a third volume of the said history extended to include the late war with Spain, which the two first volumes did not contain,and were in use as text-books at the Naval Aca demy. "2 From excerpts quoted in some re ievs, in which the page and para graph are given, there is such perver sion of facts, misconstruction of inten tion, such intemperate abuse and de famation of myself as subjects Mr. Maclay to action in civil law. While ! admit the ''rtg'fit-off air. ssssSt every public officer, I must protest against the low flings and abusive lan guage of this violent, partisan oppo nent, who has infused ito the pages cf his book so much of the malice of unfairness as to make it unworthy the name of history, or of use in any rep utabe institution of the country. "3. I have refrained heretofore from all comment upon the innuendoes of enemies muttered or murmured in se cret and therefore with safety to them selves. I think the time has now come to take such action as may bring this entire matter under discussion under the clearer and calmer review of my brothers in arms, and to this end I ask such action at the hands of the De partment as it may deem best to ac complish this purpose. "4. But I would express the request in this connection that whatever the action may be that it occur in Wash ington where most of my papers and data are stored. "Very respectfully, "W. S. Secretary Long replied to Admiral Schley as follows: "Navy Department, Washington, July 24. ... - "Sir: I am in receipt of yours of the 22d inst., with reference to the criti cisms upon you in connection with the Spanish-American war, and heartily approve of your action, under the cir cumstances, in asking at the hands of this Department 'such actions as may bring the entire matter under discus sion under the clearer and calmer re viewof my brothers in arms.'
