Davis came here yesterday to give | himself up and start serving his sen- I tence at the State Prison. But it was found on his arrival that the record and sentence in the case had not yet been certified down to the clerk of court in Buncombe county, as must be done. For the clerk of court must receive a certified copy of the judg ment of the State Supreme Court in a case that has been appealed, before he can issue commitment papers for apv prisoner. The judgment was ready to be cer tified to the Buncombe county clerk of court last night and probably will be sent to him today. But at most several days will be required before the commitment papers can be made out and sent to Davis, who intends to remain here until they are redeived. General Albert L. Cox, counsel for Davis, said today that there is little chance for these papers to be received until Friday or even later. Several days ago another western North Carolina banker, J. Mack Rhodes, of Hendersonville, arrived at the State Prison here to give himself up and start serving his sentence, im -1 posed in connection with the failure of a Hendersonville bank. But he did not have commitment papers and the prison refused to take him. Now he and Davis are both awaiting the pro per papers to admit them to prison. While the high cost of operating an automobile has not been the only fac tor in bringing about a steadily de creasing registration of automobiles in North Carolina, it has undoubtedly been a large contributing factor, Mr. Allen said. The decreased registration has brought about a decided decrease in the sale of gasoline, oil, tires and other accessories. It is because of this that this organization is beinf formed in an effort to lifhten the tax load of the automobile owners, Mr. Alien said. Other objectives of the association are vigorous opposition to any diver sion of any part of the gasoline tax for anything other than highway maintenance and construction and the enactment of legislation to put a atop to any gasoline tax evasion by distri butors or filling station operators.
